3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming and maintaining the state electronic register of holders of grain receipts

Chapter 1. General provisions

1. These rules of forming and maintaining the state electronic register of holders of grain receipts (further - Rules) are developed according to the subitem 12) of article 6 of the Law of the Republic of Kazakhstan of January 19, 2001 "About grain" (further - the Law) and determine procedure for maintaining the state electronic register of holders of grain receipts, procedure for release, the address and repayment of grain receipts, and also providing access to the state electronic register of holders of grain receipts.

2. In these rules the following basic concepts, determinations and reducings are used:

1) the web portal of information system (further – the web portal) – the Internet resource placed on the Internet to the address: www.qoldau.kz providing single point of access to data of the register;

2) the owner of grain – the physical person or legal entity which transferred to storage to cereal receiving point grain;

3) the state electronic register of holders of grain receipts (further – the register) – set of data on the grain receipts and their holders providing identification of holders of grain receipts on certain timepoint, registration of transactions with grain receipts, and also nature of the registered restrictions for the address or implementation of the rights on them, and other data reflected in information system;

4) information system of grain receipts (further – information system) – the automated system of maintaining the register intended for storage, processing, search, distribution, transfer and providing information on grain receipts and their holders;

5) the grain receipt – the warehouse certificate in the form of bank not issued security, the confirmatory property right to certain amount of grain;

6) the registrar of grain receipts (further – the registrar) – the legal entity with participation of the state in the authorized capital having work experience in the security market, determined by the Government of the Republic of Kazakhstan;

7) the holder of the grain receipt – the person registered in the register, having rights according to the grain receipt;

8) the order – the electronic document created by cereal receiving point or the holder of the grain receipt in the register, with indication of implementation of certain action concerning the grain belonging to the holder of the grain receipt, signed by the digital signature issued by national certification center;

9) personal account – set of the records containing in the register, allowing to identify the registered person for the purpose of registration of transactions and accounting of the rights according to the grain receipt;

10) the statement from personal account – the electronic document which is not security, created by the registrar in information system and confirming the rights of the registered person according to the grain receipt on certain timepoint;
