Regulations on zones of protection of objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation

1. This Provision establishes procedure for development, approval and approval of the project of zones of protection of objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation (further - objects of cultural heritage), the project of the integrated zone of protection of objects of cultural heritage, the requirement to the modes of use of lands and the general principles of establishment of requirements to town-planning regulations in borders of the territories of the specified zones.

2. In the territory integrated to the object of cultural heritage included in the unified state register of objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation in its historical circle one or several zones of protection can be established: the conservation zone, zone of regulation of building and economic activity, zone of the protected natural landscape.

For the purpose of simultaneous ensuring safety of several objects of cultural heritage in their historical circle establishment for these objects of cultural heritage of the single conservation zone, single zone of regulation of building and economic activity and single zone of the protected natural landscape is allowed (further - the integrated zone of protection of objects of cultural heritage).

3. Project development of zones of protection of objects of cultural heritage, the project of the integrated zone of protection of objects of cultural heritage is performed by physical persons or legal entities on the basis of materials of historical and architectural, historical and town-planning and archive researches (further - historical and cultural researches), and also with use of data of the State Immovable Property Cadastre in case of their availability.

4. The structure of zones of protection of objects of cultural heritage is determined by the project of zones of protection of objects of cultural heritage developed proceeding from materials of historical and cultural researches in which need of project development of zones of protection concerning one object of cultural heritage or the project of the integrated zone of protection of objects of cultural heritage is proved.

Materials of historical and cultural researches are created based on the following data:

the historical and cultural basic plan of the settlement in the territory of which there is object of cultural heritage either group of objects of cultural heritage, or fragment of the specified plan;

data on objects of cultural heritage, the revealed objects of cultural heritage, the established territories and zones of protection of the objects of cultural heritage located in the territory of expected designing of zones of protection concerning which historical and cultural researches are conducted;

materials of earlier developed projects of zones of protection of the objects of cultural heritage located in the territory of the settlement concerning which historical and cultural researches are conducted or in the mezhselenny territories if historical and cultural researches are conducted concerning separately located object of cultural heritage;

materials of the landscape and visual analysis of composition bonds of object (objects) of cultural heritage, surrounding building and landscape environment;

other materials necessary for reasons and project development of zones of protection of objects of cultural heritage.

5. The decision on project development of the integrated zone of protection of objects of cultural heritage is made by executive bodies of subjects of the Russian Federation, and on the objects of cultural heritage of federal importance recognized as especially valuable objects of cultural heritage of the people of the Russian Federation or included in the List of the world heritage - the Ministry of Culture of the Russian Federation.

6. The project of zones of protection of object of cultural heritage and the project of the integrated zone of protection of objects of cultural heritage represent documentation in text form and in the form of cards (schemes) of borders, containing the description of borders of projectible zones and borders of the territories of the objects of cultural heritage located in the specified zones, projects of the modes of use of lands and requirements to town-planning regulations in borders of these zones.
