Article 1. Purpose of this Law

This Law governs the relations, in the field of legal protection and use of trademarks, service marks and names of places of goods origin.

Article 2. Legislation on trademarks, service marks and names of places of goods origin

The legislation on trademarks, service marks and names of places of goods origin consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about trademarks, service marks and names of places of goods origin then are applied rules of the international treaty.

Article 3. Trademark and service mark

The trademark and service mark (further - the trademark) are the designation registered in accordance with the established procedure serving for difference of goods and services (further - goods) one legal entities and physical person from uniform goods of other legal entities and physical persons.

Trademarks can be individual and collective.

Individual sign is the trademark belonging to separate legal entity or physical person.

The collective mark is the trademark of merging of legal and (or) physical persons intended for designation of the goods issued and (or) realized by them having single quality or other general characteristics.

As trademarks graphic, verbal, volume and other designations or their combinations in any color or color combination can be registered.

Article 4. Legal protection of the trademark

Legal protection of the trademark is provided based on its registration according to the procedure, established by this Law, and also owing to international treaties of the Republic of Uzbekistan.

The trademark can be registered addressed to legal entity or physical person.

Article 5. Name of the place of goods origin

The name of the place of goods origin the country name, the settlement, the area or other geographical object (further - geographical object) used for designation of goods which special characteristics only or are mainly determined by environment or other factors or combination of environment and these factors, characteristic of this geographical object, is recognized.

Article 6. Legal protection of the name of the place of goods origin

Legal protection of the name of the place of goods origin is provided based on its registration according to the procedure, established by this Law, and also owing to international treaties of the Republic of Uzbekistan.

The name of the place of goods origin can be registered by one or several legal entities or physical person which are in this geographical object which name is used for designation of the goods made by them.

Person which registered the name of the place of goods origin acquires right to use it if this person makes goods which special characteristics only or are mainly determined by environment or other factors or combination of environment and these factors, characteristic of this geographical object.

Right to use by the name of the place of goods origin registered according to the procedure, established by this Law, can be provided also to other legal entity or physical person which is in the same geographical object and making goods with the same special characteristics.

Article 7. Authorized state body

Authorized state body in the field of protection of trademarks and names of places of goods origin is the Agency on intellectual property under the Ministry of Justice of the Republic of Uzbekistan (further - the Agency).

Agency:

participates in forming and realization of single state policy in the field of protection of trademarks and names of places of goods origin;
