Approve the Procedure for the organization and maintaining the Republican register of ecological auditors and environmental auditing organizations it (is applied).

Procedure for the organization and maintaining the Republican register of ecological auditors and auditing environmental organizations

1. General provisions

1.1. The procedure for the organization and maintaining the Republican register of ecological auditors and auditing environmental organizations (further - the Procedure) is developed for the purpose of ensuring execution of article 11 of the Law of the Republic of Tajikistan "About environmental audit", determines single requirements and procedure for maintaining the Republican register of the ecological auditors and auditing environmental organizations having the right to carrying out environmental audit.

1.2. In this Procedure the following basic concepts are used:

- The republican register of the ecological auditors and auditing environmental organizations having the right to implementation of environmental audit (further - the Register) the document determining the list of the ecological auditors and auditing environmental organizations having the right to carrying out environmental audit according to requirements of the Law of the Republic of Tajikistan "About environmental audit";

- the applicant - the legal entity or physical person having the right to carrying out environmental audit which gives to Committee on environmental protection under the Government of the Republic of Tajikistan (further - Committee) the statement for entering into the Register.

2. Procedure for entering into the Register of data

2.1. The following data are entered in the Register:

- about the ecological auditors having the license for occupation ekologo-auditor activities granted in accordance with the established procedure by Committee;

- about legal entities in whose charter this type of activity is provided and in which state one specialist having the license for occupation ekologo-auditor activities works at least.

2.2. Entering into the Register of ecological auditors is performed from the moment of receipt of the License for occupation by them by ekologo-auditor activities.

2.3. For entering into the Register the applicant submits the following documents to Committee:

a) the statement in the established form given in appendix 1;

b) copy of the certificate of the state register;

c) extract from the Unified State Register of Legal Entities and individual entrepreneurs;

d) copy of the Charter of the legal entity;

e) the reference documenting availability in staff of the applicant at least of one specialist having the License for occupation ekologo-auditor activities;

e) copy of the qualified certificate of the ecological auditor;

ё) copy of the License of the ecological auditor.

2.4. The applicant directs the statement for entering into the Register and other necessary documents by mail or gives personally to Committee, with the internal inventory and the numbered sheets. The filed documents are registered in Committee in the special magazine.

2.5. The documents filed by the applicant for entering into the Register are considered on commission session on entering into the Register of ecological auditors of Committee (further - the Commission). The decision of the Commission is drawn up by the minutes (appendix 2).

2.6. The message on entering into the Register given in appendix 3 or the decision on refusal concerning entering into it is provided to the applicant personally or is sent by the registered mail within seven working days from the date of execution of the minutes of the Commission. In the decision on refusal concerning entering into the Register the motivated bases of such refusal are specified.

2.7. The motivated bases for decision making of the Commission about refusal to the applicant concerning its entering into the Register are:

- discrepancy of the filed documents enclosed to the application, requirements of the legislation of the Republic of Tajikistan; representation not in full the documents provided by this Procedure.

3. Final provisions

3.1 The applicant has the right to appeal in accordance with the established procedure in court the decision of the Commission on refusal in entering into the Register.

- the reference documenting availability in staff of the applicant at least of one specialist having the License for occupation of the ecologist - auditor activities;

- copy of the Certificate of competency of the ecological auditor;

- copy of the License of the ecological auditor.
