1. Approve the enclosed Rules of execution of warranty obligations (certificates of end users).

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan provision in Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

About approval of Rules of execution of warranty obligations (certificates of end users)

Chapter 1. General provisions

1. These rules of execution of warranty obligations (certificates of end users) (further - Rules) are developed according to the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law) and determine procedure for execution of warranty obligations (certificates of end users).

2. "Issue of the warranty obligation (end-user certificate)" is the state service (further - the state service) and it appears Committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the service provider) according to these rules.

3. The warranty obligation (end-user certificate) is issued if according to requirements of the exporter provision of obligations of the consumer on use of products imported to the Republic of Kazakhstan in stated purposes is necessary.

4. The warranty obligation (end-user certificate) is drawn up on one transaction irrespective of quantity and the product range included in the agreement in foreign trade (contract).

5. Modification of the warranty obligation (end-user certificate) is not allowed.

Chapter 2. Procedure for rendering the state service

6. For receipt of the state service physical persons and legal entities (further - uslugopoluchatel) submit to the service provider through the web portal of "the electronic government" www.egov.kz (further - the portal) documents according to the Standard of the state service according to appendix 1 to these rules (further - the Standard of the state service).

The list of the main requirements to rendering the state service including the characteristic of process, form, content and result of rendering, and also other data taking into account features of rendering the state service are stated in the Standard of the state service.

When giving the uslugopoluchatel of all necessary documents by means of the portal - in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.

7. The employee of office of the service provider performs acceptance and document registration, arrived through the portal, in day of their receipt and sends to the head of the service provider which appoints the contractor.

8. The contractor within 2 (two) working days checks completeness of the submitted documents and, in case of establishment of incompleteness of the submitted documents, prepares motivated refusal in further review of documents in form according to appendix 2 to these rules (further - motivated refusal) which goes in electronic form, signed by the digital signature (further - the EDS) the head of the service provider or replacement his face, in personal account of uslugopoluchatel on the portal.

Data on the identity document, on state registration (re-registration) of the legal entity, the individual entrepreneur, the service provider receives from the corresponding state information systems through lock of "the electronic government".
