Article 1. Central Election Commission of the Republic of Uzbekistan

The Central Election Commission of the Republic of Uzbekistan (further Central Election Commission) is formed for the organization and elections of the President of the Republic of Uzbekistan, in Oliy Majlis of the Republic of Uzbekistan, and also referendum of the Republic of Uzbekistan and performs the activities on permanent basis.

Article 2. Basic principles of activities of Central Election Commission

The basic principles of activities of Central Election Commission are independence, legality, collective nature, publicity, justice.

The Central Election Commission is designed by all the activities to promote implementation of democratic principles of the electoral system, to provide possibility of free declaration of will of voters.

Article 2-1. Independence

Central Election Commission and its members perform the activities irrespective of any state bodies, public associations and officials.

Members of Central Election Commission, making decisions, express the line item, free from political tendencies and other foreign impacts.

Intervention in activities of Central Election Commission is not allowed and involves responsibility according to the law.

Article 2-2. Legality

Central Election Commission and its members in the activities are guided by the Constitution of the Republic of Uzbekistan, the laws on elections, referendum and other legal acts.

Article 2-3. Collective nature

Consideration of questions and decision making are performed by Central Election Commission jointly.

Article 2-4. Publicity

The Central Election Commission performs the activities publicly. Meetings of Central Election Commission are held openly.

At meetings of Central Election Commission there can be representatives of political parties, mass media, observers from other states, the international organizations and movements.

Decisions of Central Election Commission are published in mass media.

Article 2-5. Justice

The Central Election Commission takes necessary measures for providing to candidates, political parties of equal conditions for holding the election campaign, equitable distribution of the budgetary funds allocated for preparation and elections, referendum, honesty of vote and summing up elections, referendum.

Article 3. Formation of Central Election Commission

The Central Election Commission is formed by Oliy Majlis of the Republic of Uzbekistan as a part of at least fifteen members.

Members of Central Election Commission are elected by Legislative house and the Senate of the Oliy Majlis of the Republic of Uzbekistan according to the recommendation of the Jokargi Kenes of the Republic of Karakalpakstan, regional and Tashkent city Kengasha People's Deputies.

The chairman of Central Election Commission is elected from among her members on representation of the President of the Republic of Uzbekistan on commission session.

The vice-chairman and the secretary of Central Election Commission are elected from among her members on commission session.

Article 4. Membership in Central Election Commission

The citizen of the Republic of Uzbekistan who reached twenty five years, having, as a rule, the higher education, work experience in the organization and elections of the President of the Republic of Uzbekistan and in representative bodies of the government, referendum, holding authority among the public and constantly living in the territory of the Republic of Uzbekistan at least five last years can be the member of Central Election Commission.

The citizens having the outstanding or not removed criminal record for the committed heavy or especially serious crimes, the military personnel of Armed Forces, the staff of Service of state security of the Republic of Uzbekistan, other militarized divisions, professional attendants of the religious organizations and associations cannot be members of Central Election Commission.

The member of Central Election Commission cannot be the member of other electoral commission or political party.

The member of Central Election Commission registered in the procedure established by the law by the candidate for president of the Republic of Uzbekistan, the candidate of Legislative house of Oliy Majlis of the Republic of Uzbekistan, the alternate member of the Senate of the Oliy Majlis of the Republic of Uzbekistan is considered the authorized representative disposed from structure of the commission.

Powers of the member of Central Election Commission can be stopped by Oliy Majlis of the Republic of Uzbekistan directly or on representation of the body recommending it in cases:

submissions of the written application by it about abdication;

its recognition in accordance with the established procedure incapacitated;

introductions concerning it in legal force of conviction of court;

systematic failure to carry out of the obligations by it.

The new member of Central Election Commission affirms according to the procedure, established by this Law.

The member of Central Election Commission according to its decision can work in the commission at permanent basis.

The members of Central Election Commission working at permanent basis cannot be engaged in other types of paid activities, except scientific and pedagogical.

Article 4-1. Certificate of the member of Central Election Commission

The member of Central Election Commission has the corresponding certificate.

The certificate of the chairman of Central Election Commission and his deputy is signed by the President of the Republic of Uzbekistan, and the certificate of other members of Central Election Commission is signed by the Chairman of the Senate of the Oliy Majlis of the Republic of Uzbekistan in coordination with the Speaker of Legislative house of Oliy Majlis of the Republic of Uzbekistan.

Article 5. Powers of Central Election Commission

Central Election Commission:

heads system of the electoral commissions and commissions on holding referendum which are formed for elections of the President of the Republic of Uzbekistan, in Oliy Majlis of the Republic of Uzbekistan and referendum of the Republic of Uzbekistan, exercises in all territory of the Republic of Uzbekistan control of execution of the laws on election of the president of the Republic of Uzbekistan, in Oliy Majlis of the Republic of Uzbekistan and referendum of the Republic of Uzbekistan, provides their uniform application;
