About approval of Rules of development, approval of development plans for the joint-stock companies and limited liability partnerships, the state companies, and also monitoring and assessment of their realization controlled by the state
According to subitem 4-1 of article 13 of the Law of the Republic of Kazakhstan of March 1, 2011 "About state-owned property" PRIKAZYVAYU:
1. Approve the enclosed Rules of development, approval of development plans for the joint-stock companies and limited liability partnerships, the state companies, and also monitoring and assessment of their realization controlled by the state.
2. To provide to department of policy of management of the state assets of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) after state registration in the Ministry of Justice of the Republic of Kazakhstan of this order to bring it to the attention of state bodies, local executive bodies exercising control of the state companies, rights of possession and uses of the state blocks of shares of joint-stock companies and the state shares in the authorized capital of limited liability partnerships;
3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;
4) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let.
3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of development, approval of development plans for the joint-stock companies and limited liability partnerships, the state companies, and also monitoring and assessment of their realization controlled by the state (further - Rules) are developed according to subitem 4-1) of article 13 of the Law of the Republic of Kazakhstan of March 1, 2011 "About state-owned property" and determine procedure for development, approval of development plans for the joint-stock companies controlled by the state (further - the joint-stock company), limited liability partnerships (further - limited liability partnership) and the state companies (further - GP), and also monitoring and assessment of their realization, except for national managing holdings, national holdings and the national companies.
2. The basic concepts used in these rules:
1) executive body - collegiate organ or person solely performing functions of executive body which name is determined by articles of organization;
2) the development plan (further - the development plan) - the document determining the main activities and indicators of financial and economic activities of GP, the joint-stock company and limited liability partnership, controlling stock (share in the authorized capital) which belongs to the state;
3) local executive body (akimat) - the collegiate executive body headed by the akim of area (the city of republican value and the capital), the area (the city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;
4) the executive bodies financed from the local budget - management (departments) given authority on implementation of rights of possession and use of the state block of shares of joint-stock companies and shares in limited liability partnerships, persons of law of the state legal entities including on decision making;
5) the single operator in the sphere of accounting of state-owned property (further - the single operator) - the legal entity determined by the decision of the Government of the Republic of Kazakhstan to which tasks on realization of single technical policy in the sphere of the organization and accounting of state-owned property are assigned;
6) authorized body of the corresponding industry - the central executive body determined by the Government of the Republic of Kazakhstan, which is performing management of the corresponding industry (sphere) of public administration and having rights concerning republican property on the conditions provided by the Law of the Republic of Kazakhstan "About state-owned property" and other laws of the Republic of Kazakhstan;
7) the organizations - the joint-stock companies and limited liability partnership controlled by the state, GP, including, delivered in trust management.
3. The development plan is developed once for the five-year period and approved with authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district, on compliance to the purposes and tasks stated in strategic and program documents of the Republic of Kazakhstan and the strategic plan of state body, the development program of the territories.
4. Plan development of development is performed according to structure, forms, the list of indicators in forms according to appendices 1, of 2, of 3, of 4, of 5, of 6, of 7, of 8, of 9, of 10, of 11, of 12, of 13, of 14, of 15, of 16, of 17, of 18, of 19, of 20, of 21, of 22, of 23, of 24, of 25, of 26, of 27, of 28, 28-1, 29, 30 to these rules.
5. The development plan for the organization contains the purposes, tasks, indicators of results both the main consolidated and unconsolidated indicators of financial and economic activities, including investments, the income, expenses, loans, dividends (the part of net income which is subject to budget contribution), indicators of financial stability and other data.
6. Authorized body of the corresponding industry or local executive body (the executive body financed from the local budget), except for authorized bodies of the corresponding industries which are not developing strategic plans develop and bring to the organization till September first of the year preceding the planned period:
1) the purposes and tasks of organization activity leading to goal achievement and accomplishment of the tasks of state body (local executive body) reflected in its strategic plan (the development program of the territory);
2) quantitatively measurable key indicators characterizing organization activity on accomplishment of the purposes and tasks of state body (local executive body) reflected in its strategic plan (the development program of the territory).
Key indicators reflect direct results (provision of products (works, services) of certain amount and quality), and resulting effects (effect of provision of products (works, services) for their receivers).
Key indicators contain quality indicators (products compliance degree (works, services) to expectations of her receivers) and performance indicators (decrease in use of resources on production of unit of production (works, services) in natural or value term.
In cases of modification or amendments or approvals in the new edition of the strategic plan of state body (development programs of the territory), the authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) specify for the organization of the purpose and task, and also key indicators within one month after modification or amendments or approval in the new edition of the strategic plan of state body (development programs of the territory).
7. The authorized bodies of the corresponding industries which are not developing strategic plans bring the office of the akim of the city of district value, the village, settlement, rural district to the organization till September first of the year preceding the planned period:
1) the purposes and tasks of organization activity leading to goal achievement and accomplishment of tasks of the budget program of authorized body of the corresponding industry, the office of the akim of the city of district value, the village, settlement, rural district reflected in their budget programs;
2) quantitatively measurable key indicators characterizing organization activity on accomplishment of the purposes and tasks of authorized body of the corresponding industry, the office of the akim of the city of district value, the village, settlement, rural district reflected in their budget programs.
Key indicators reflect direct results (provision of products (works, services) of certain amount and quality), and resulting effects (effect of provision of products (works, services) for their receivers).
Key indicators contain quality indicators (products compliance degree (works, services) to expectations of her receivers) and performance indicators (decrease in use of resources on production of unit of production (works, services) in natural or value term.
In cases of modification, amendments or approvals in the new edition of the budget program, the authorized body of the corresponding industry, the office of the akim of the city of district value, the village, settlement, rural district specifies for the organization of the purpose and task, and also key indicators within one month after modification and amendments or approval in the new edition of the budget program.
8. Plan development of development for the corresponding planned period, and also modification and amendments of the development plan is performed by executive body of the organization with use of the software developed by the single operator in the following procedure:
1) first year: the main indicators of financial and economic activities of the first planned year are reflected in the deciphered (developed) type, the subsequent planned years in aggregative (summary) type with breakdown by years with indication of the made corrections;
2) second year: assessment of the first year, the second year in the deciphered (developed) type, the next years in aggregative (summary) type in breakdown by years with indication of the made corrections;
3) third year: the fact of the first year and assessment of the second year, the third year in the deciphered (developed) type, the next years in aggregative (summary) type in breakdown by years with indication of the made corrections;
4) fourth year: the fact of first, second and assessment of the third year, the fourth year in the deciphered (developed) type, the next years in aggregative (summary) type in breakdown by years with indication of the made corrections;
5) fifth year: the fact of the first, second, third and assessment of the fourth year, the fifth year in the deciphered (developed) type with indication of the made corrections.
In the development plan aggregative indicators, including indicators on goal achievement and accomplishment of tasks, key indicators are specified. The explanatory note to the development plan contains annual assessment of previous years taking into account adjustments and reasons for aggregative indicators for the forthcoming period before the end of the planned period. If adjustment of the development plan does not affect aggregative indicators, they remain invariable for all planned period.
Plan development of development for the corresponding planned period, for the newly created organizations is performed by executive body of the organization with use of the software developed by the single operator from the date of state registration of the organization in judicial authorities.
9. The executive body till October first of the year preceding the planned period directs the draft of the development plan, and also annual adjustments (the second - the fifth years of the development plan) to consideration and coordination to authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district.
In the state companies on the right of economic maintaining the executive body approves previously the draft of the development plan with the supervisory board before introduction with the supervisory board it on coordination to authorized body of the corresponding industry or local executive body (the executive body financed from the local budget).
The authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or to the office of the akim of the city of district value, the village, settlement, rural district consider the draft of the development plan within fifteen working days from the date of its receipt.
In the presence of notes the executive body within ten working days finishes the draft of the development plan and repeatedly submits it for approval to authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district.
The authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district within ten working days consider the modifed draft of the development plan.
10. The executive body till November fifteenth of the year preceding the planned period submits the agreed project of the development plan for consideration to the board of directors of joint-stock company (the supervisory board of limited liability partnership).
The board of directors of joint-stock company (the supervisory board of limited liability partnership) considers the draft of the development plan within fifteen working days from the date of its receipt.
In the presence of notes the executive body within ten calendar days finishes the draft of the development plan and repeatedly submits it for consideration to the board of directors of joint-stock company (the supervisory board of limited liability partnership).
The board of directors of joint-stock company (the supervisory board of limited liability partnership) within ten calendar days considers the modifed draft of the development plan.
11. The development plan, and also adjustments of the approved development plan affirms the board of directors of joint-stock company, the supervisory board of limited liability partnership, on the state companies - authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district till December twenty fifth of the year preceding the planned period.
12. The organization within five working days from the date of approval of the development plan directs the report on its approval (further - the report) in electronic form with use of the software and the signed digital signature of the organization issued by national certification center. The report goes to the single operator for inclusion in the register, having attached to it the scanned solution of the board of directors of joint-stock company (the supervisory board of limited liability partnership, authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, the settlement, the rural district).
13. The single operator within five working days, from the date of receipt of the report directs to the e-mail address of the organization the notification on inclusion of the report in the Register of state-owned property or the notification on refusal in adoption of the report.
The basis for refusal in adoption of the report are:
1) lack of the scanned decision of the governing body specified in Item 12 of these rules attached to the report on approval of the development plan;
2) signing of the report the digital signature which is not belonging to the organization.
In case of refusal the single operator in adoption of the electronic report, the organization resolves comments and introduces repeatedly electronic report to the single operator within five working days from the date of receipt of the notification on refusal in adoption of the report.
14. Adjustment of the development plan is allowed no more once a half-year.
The executive body no later than sixty calendar days before date of completion of half-year submits for consideration to the board of directors of joint-stock company, the supervisory board of limited liability partnership, authorized body of the corresponding industry (the local executive body or executive body financed from the local budget or to the office of the akim of the city of district value, the village, settlement, rural district) by the state company the changed draft of the development plan with the corresponding reasons.
In the presence of notes the executive body within five working days finishes the draft of the corrected development plan and repeatedly submits it for consideration to the board of directors of joint-stock company, the supervisory board of limited liability partnership, authorized body of the corresponding industry (the local executive body or executive body financed from the local budget or to the office of the akim of the city of district value, the village, settlement, rural district) by the state company.
The corrected development plan affirms the board of directors of joint-stock company, the supervisory board of limited liability partnership, authorized body of the corresponding industry (the local executive body or executive body financed from the local budget or the office of the akim of the city of district value, the village, settlement, rural district) the state company no later than thirty calendar days before date of completion of half-year.
Modification and amendments in the development plan is allowed in the cases connected with:
1) the president's letter of the Republic of Kazakhstan to the people of Kazakhstan about provision in the country and the main directions of domestic and foreign policy, the change made to the documents of system of state planning, and also change of internal and external environment having essential effect on organization activity;
2) change of the main activities of the organization;
3) modification and amendments in the strategic plan of state body (the development program of the territory) or adoption of the specified documents in the new edition including connected with financing from the budget or the budget crediting of the joint-stock companies and limited liability partnerships, the state companies controlled by the state.
15. Annually executive body submits for consideration to the board of directors of joint-stock company, the supervisory board of limited liability partnership, on the state companies - authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district the draft of the corrected development plan (second or fifth of the development plan) with the corresponding reasons.
The draft of the corrected development plan includes offers on assessment of realization of previous years of the development plan, aggregative indicators of the development plan before the end of the planned period.
In the state companies on the right of economic maintaining the executive body approves previously the draft of the corrected development plan with the supervisory board before introduction with the supervisory board it on coordination to authorized body of the corresponding industry or local executive body (the executive body financed from the local budget).
The board of directors of joint-stock company, the supervisory board of limited liability partnership, on the state companies - the authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district consider the draft of the corrected development plan with the corresponding reasons within fifteen working days from the date of its receipt.
In the presence of notes the executive body within five working days finishes the draft of the corrected development plan and repeatedly submits it for consideration to the board of directors of joint-stock company, the supervisory board of limited liability partnership, on the state companies - authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district.
The board of directors of joint-stock company, the supervisory board of limited liability partnership, on the state companies - the authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district within ten days consider the modifed draft of the development plan.
16. The executive body within five working days from the date of decision making about entering of adjustments into the development plan provides submission of the electronic report to the single operator for inclusion in the register according to Items 12 and 13 of these rules.
17. Monitoring of implementation of development plans for the organization is performed by authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district for the purpose of the analysis and generalization of information on accomplishment of indicators of strategic and program documents of the Republic of Kazakhstan (Development programs of the territories) and accomplishment of indicators of financial and economic activities.
18. Results of monitoring of implementation of the development plan for the organization it is carried out annually within thirty calendar days after approval by the board of directors, the supervisory board, on the state companies - authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district of the report on execution of the development plan for the organization.
Monitoring of implementation of the development plan for the organization is carried out on the basis of the development plan and the report on execution of the development plan for the organization approved by the board of directors, the supervisory board, authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district.
19. Monitoring of implementation of the development plan for the organization contains:
1) information on the planned and actually reached key indicators of activities, the reasons of their not achievement;
2) the analytical note constituted in any form and containing the following data:
conclusions about results of implementation of the development plan for the accounting period by key indicators of activities, the purposes and tasks, including extent of their achievement (in the presence of variations of the actual results from planned it is necessary to open the reasons and factors which exerted impact on resulting effects);
problems which arose in implementation process of the development plan, their impact on the purposes and key indicators of activities, and also the taken measures for the solution of the revealed problems and ensuring timely implementation of the development plan;
3) recommendations about continuation of implementation of the development plan for the organization, to modification or amendments in the development plan for the organization, to taking measures to ensuring timely realization by executives in charge of the planned actions and others;
4) in case of need review of the separate purposes, tasks, actions, redistribution of resources, suspension of those effect which are had inefficient, and developments of new approaches to overcoming problems and to elimination of weak points.
20. Results of monitoring are used by authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district, the board of directors (supervisory board) of the joint-stock companies and limited liability partnerships controlled by the state for the purpose of goal achievement, tasks, indicators of the development plan for the organization.
21. Results of monitoring within ten working days from the date of consideration send authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district for inclusion in the register in electronic form with use of the software "Single system of submission of reports" (with attachment to it to the scanned copy of paper version of the conclusion, the signed and confirmed seal), according to appendix 29 to these rules which are signed by the digital signature of the head of authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, the settlement, the rural district.
The single operator within five working days from the date of receipt of results of monitoring directs to the e-mail address of authorized body of the corresponding industry or local executive body or the office of the akim of the city of district value, the village, settlement, rural district the notification on inclusion of results of monitoring in the register or the notification on refusal in its acceptance. The basis for refusal by the single operator in acceptance of results of monitoring is violation of the corresponding industry by authorized body or local executive body or the office of the akim of the city of district value, the village, settlement, rural district of the requirements specified in this Item of Rules.
In case of refusal the single operator in acceptance of results of monitoring, the authorized body of the corresponding industry or local executive body or the office of the akim of the city of district value, the village, settlement, rural district resolve comments and bring repeatedly result of monitoring to the single operator within five working days from the date of receipt of the notification on refusal in acceptance of results of monitoring.
Results of monitoring of implementation of development plans for the organization are used in case of efficiency evaluation of management of state-owned property.
22. Assessment of implementation of the development plan for the joint-stock companies and limited liability partnership controlled by the state is performed by their board of directors, the supervisory board, the state companies - authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, settlement, rural district, after approval of the audited financial reporting.
23. The list of indicators of assessment of implementation of the development plan for the organization includes assessment:
1) accomplishment of the development plan for the organization on compliance of accomplishment of program and strategic documents of the country;
2) accomplishment of financial performance of organization activity;
3) implementation of investment (innovative) projects;
4) corporate management;
5) accomplishment of the other purposes, tasks and assessment of achievement of the predicted key indicators of activities reflected in the approved development plan for the organization.
24. Results of assessment of implementation of the development plan for the organization are represented by executive body to the single operator within five days after approval of assessment of implementation of the development plan with provision of the scanned copy of the solution of the board of directors of joint-stock company, the supervisory board of limited liability partnership, authorized body of the corresponding industry or local executive body (the executive body financed from the local budget) or the office of the akim of the city of district value, the village, the settlement, the rural district.
25. In case of attraction of loans, the organizations direct information on loans and temporarily free money for inclusion in the register in electronic form with use of the software "Single system of submission of reports", according to appendix 30 to these rules which is signed by the digital signature executive body of the organization.
In case of attraction of loans, the organizations develop risk management policy which affirms the board of directors for joint-stock companies, the supervisory board for limited liability partnerships and state body for the state companies.
