About perpetuating of victory over Nazism in World War II of 1939-1945

(as amended on 29-05-2023)

According to the Constitution of Ukraine, in particular to Article 11, which obliges the state to promote consolidation and development of the Ukrainian nation, her historical consciousness,

relying on General Assembly resolutions of November 22, 2004 No. A/RES/59/26 and of March 2, 2010 No. A/RES/64/257,

aiming to develop and strengthen the independent, democratic, constitutional state,

realizing that World War II of 1939-1945 which began as a result of arrangements of the national socialist (Nazi) mode of Germany and communist totalitarian regime of the USSR, became the greatest tragedy of mankind in the 20th century,

In spite of the fact that during World War II of 1939-1945 national socialist (Nazi) and communistic totalitarian the modes in the territory of Ukraine committed numerous crimes against humanity and humanity, war crimes and crimes of genocide therefore huge losses were put to Ukraine and the Ukrainian people,

noting world-wide and historical value of victory over Nazism in World War II of 1939-1945,

paying tribute to the memory of all victims of World War II of 1939-1945 and considering need of permanent care of veterans of war, participants of liberation movement and the victims of Nazism,

for the purpose of preserving memory of victory over Nazism in World War II of 1939-1945 the Verkhovna Rada of Ukraine adopts this law.

Article 1. Perpetuating of victory over Nazism in World War II of 1939-1945

1. Respect for memory of victory over Nazism in World War II of 1939-1945, about veterans of war, participants of the Ukrainian liberation movement and the victims of Nazism is sacred obligation of the state and citizens of Ukraine.

2. For the purpose of celebration of memory of all victims of World War II of 1939-1945 and the celebration of victory over Nazism annually on May 8 in Ukraine Day of remembrance and victories over Nazism in World War II of 1939-1945 is celebrated";

in Item of 1 part one of Article 2 of the word "Day of remembrance and conciliation, the Victory Day" shall be replaced with words also in figures "Day of remembrance and victory over Nazism in World War II of 1939-1945.

Article 2. Forms of perpetuating of victory over Nazism in World War II of 1939-1945

1. The main forms of perpetuating of victory over Nazism in World War II of 1939-1945 are:

1) celebration of Day of remembrance and conciliation, the Victory Day, days of exile of Nazis from Ukraine, the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, other administrative and territorial units;

2) establishment of guard of honor at the Eternal flame, the Tombs of the Unknown Soldier and the Unknown sailor, wreath-laying, flowers to the monuments and memorials devoted to perpetuating of victory over Nazism and memory of the victims of World War II of 1939-1945;

3) non-admission of falsification of history of World War II of 1939-1945 in scientific research, educational and methodical literature, textbooks, media, public statements of representatives of state bodies, local government bodies, officials;

4) assistance to objective and comprehensive investigation of history of World War II of 1939-1945, to reflection of events of war, its victims, actions of participants in literary works and arts, books and albums of memory, media;

5) streamlining, preserving and construction of monuments and memorable signs in honor of memory of participants and victims of World War II of 1939-1945, creation of the museums, the memorial complexes devoted to World War II of 1939-1945;

6) ensuring carrying out with assistance of the state of search work with the purpose of establishment of names of the dead and those who were missing, reburial of remains of the soldiers who died during World War II of 1939-1945.

Article 3. Guard of honor

1. During the celebration of Day of remembrance and victory over Nazism in World War II of 1939-1945, Day of defenders and defenders of Ukraine in the capital of Ukraine, the capital of the Autonomous Republic of Crimea, the city of Sevastopol, in the regional centers at the monuments and memorials devoted to perpetuating of victory over Nazism and celebration of memory of the victims of World War II of 1939-1945 the guard of honor is established, and also wreathes and flowers are laid.

Article 4. Monuments of World War II of 1939-1945

1. Monuments of World War II of 1939-1945 military cemeteries, military sites at civil cemeteries, mass and single graves, monuments, memorable signs, sculptural, architectural and other constructions, compositions and objects which immortalize memory of events of times of World War II of 1939-1945, her participants and victims are recognized.

The unified national register of monuments of World War II of 1939-1945 affirms the Cabinet of Ministers of Ukraine.

2. The sights determined by part one of this Article are under protection of the state.

3. Financing of the actions connected with content in proper condition of monuments, determined by part one of this Article is performed at the expense of means state and the local budgets provided on the answering purpose and also at the expense of donations of legal, physical persons, the international organizations or foreign states.

4. State bodies and local government bodies bear responsibility for accounting and storage of monuments of World War II of 1939-1945 within competence.

5. Search of unknown military burials, remains of the victims and soldiers which died in World War II of 1939-1945 is performed according to the procedure, determined by the Cabinet of Ministers of Ukraine.

6. Burial of combatants during World War II of 1939-1945 is performed by executive bodies and local government bodies at the expense of means state and local budgets.

7. Violation of monuments of World War II of 1939-1945, their destruction or destruction attracts legal accountability.

Article 5. The international agreements on mitigation of consequences of World War II of 1939-1945 and preserving the monuments connected with events of World War II of 1939-1945

1. Ukraine provides accomplishment of international treaties on mitigation of consequences of World War II of 1939-1945 and signs contracts on compensation of damage to the victims of Nazism. Based on international treaties Ukraine provides construction and preserving monuments in places of burials of the soldiers who died during World War II of 1939-1945 outside the territory of Ukraine.

2. Ukraine within international treaties promotes identification of burials of times of World War II of 1939-1945 located in its territory, to construction and preserving monuments in places of burials, to revival of the humanistic attitude towards them.

3. Ukraine steadily adheres to the international obligations on non-admission of manifestations of Nazism and totalitarianism in any form in the territory.
