1. These General rules establish procedure for determination of requirements to the separate types of goods, works, services which are purchased by customers (including marginal prices of goods, works, services).

The State Atomic Energy Corporation "Rosatom" and the State corporation on space activities Roskosmos approve requirements to the separate types of goods, works, services which are purchased by them (including marginal prices of goods, works, services) according to the procedure, established by these General rules.

Under the guise of goods, works, services for the purpose of these General rules the types of goods, works, services corresponding to 6-unit code of line item under the All-Russian Product Classifier by types of economic activity are understood.

2. The government of the Russian Federation, the supreme executive bodies of the government of subjects of the Russian Federation and local administrations establish applied by state bodies, governing bodies of state non-budgetary funds, municipal authorities, their territorial authorities and state organizations, budgetary institutions and the unitary enterprises of the rule of determination of requirements subordinated to them to the separate types of goods, works, services which are purchased by them (including marginal prices of goods, works, services) for providing according to federal needs, needs of subjects of the Russian Federation and municipal needs (further - rules of determination of requirements).

3. Requirements to the separate types of goods, works, services which are purchased by state bodies, governing bodies of state non-budgetary funds, municipal authorities, their territorial authorities (divisions) and state organizations, budgetary institutions and the unitary enterprises subordinated to them (including marginal prices of goods, works, services) affirm state bodies, governing bodies of state non-budgetary funds and municipal authorities in the form of the list of separate types of goods, works, services concerning which consumer properties (including characteristics of quality) and other characteristics having influence on the price of separate types of goods, works, services are established (further - the departmental list).

4. Rules of determination of requirements provide:

a) the obligatory list of separate types of goods, works, services, their consumer properties and other characteristics, and also values of such properties and characteristics (including marginal prices of goods, works, services) (further - the obligatory list) and (or) obligation of state bodies, governing bodies of state non-budgetary funds and municipal authorities to establish values of the specified properties and characteristics;

b) procedure for forming and maintaining by state bodies, governing bodies of state non-budgetary funds and municipal authorities of the departmental list, and also approximate form of the departmental list;

c) procedure for application of these General rules of obligatory selection criteria of separate types of goods, works, services specified in Item 11, the values of these criteria, and also the additional criteria which are not determined by these General rules and not leading to narrowing of the departmental list and procedure for their application.

5. Rules of determination of requirements can provide the following data which are in addition included by state bodies, governing bodies of state non-budgetary funds and municipal authorities in the departmental list:

a) the separate types of goods, works, services which are not specified in the obligatory list;

b) the characteristics of goods, works, services which are not included in the obligatory list and not leading to unreasonable restrictions of the number of procurement participants;

c) the values of quantitative and (or) qualitative indexes of characteristics (properties) of goods, works, services different from the values containing in the obligatory list, in the cases provided by rules of determination of requirements. At the same time such values shall be proved, including with use of functional purpose of goods which for the purposes of these General rules is understood as the purpose and conditions of use (application) of goods allowing goods to perform the basic purpose, support functions or determining universality of use of goods (accomplishment of the corresponding functions, works, rendering the corresponding services, territorial, climatic factors and another);

d) other data concerning purchase of goods, works, services, which are not provided by these General rules.

6. The obligatory list and the departmental list are created taking into account:

a) provisions of technical regulations, standards and other provisions, stipulated by the legislation the Russian Federation, including the legislation of the Russian Federation on energy saving and on increase in energy efficiency and the legislation of the Russian Federation in the field of environmental protection;

b) provisions of article 33 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs";

c) the principle of the ensuring the competition determined by article 8 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs".

7. The departmental list is created taking into account functional purpose of goods and shall contain one or several following characteristics concerning each separate type of goods, works, services:

a) consumer properties (including quality and other characteristics);

b) other characteristics (properties) which are not consumer properties;

c) marginal prices of goods, works, services.
