1. Approve:

1) Rules of certification and issue of the certificate of service of aviation safety of the airport (airfield), according to appendix 1 to this order;

2) Certified requirements to service of aviation safety of the airport (airfield), according to appendix 2 to this order.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. I reserve control of execution of this order.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of certification and issue of the certificate of service of aviation safety of the airport (airfield)

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of service of aviation safety of the airport (airfield) (further – Rules) are developed according to subitem 41-53) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for carrying out certification and issue of the certificate of service of aviation safety of the airport (airfield).

2. In Rules the following terms and determinations are used:

1) the request – the written appeal of the applicant to authorized organization in the sphere of civil aviation for passing of the procedure of certification of service of aviation safety of the airport (airfield);

2) the applicant – the operator of the airport who addressed to authorized organization in the sphere of civil aviation for receipt of the certificate of service of aviation safety of the airport (airfield);

3) certified inspection – the inspection of means, the equipment, engineering procedures performed by authorized organization in the sphere of civil aviation, documentation, organizational structure, competence of personnel on compliance to certified requirements;

4) the technical means used in case of examination – special devices, held for use independently or as part of any system when implementing examination of passengers, hand luggage, freight, baggage, mail, onboard inventories, members of crews of the aircrafts, aviation personnel and other persons visiting air terminal facility (airfield);

5) authorized organization in the sphere of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety.

3. The state service "Issue of the Certificate of Service of Aviation Safety of the Airport (Airfield)" (further – the state service) appears authorized organization in the sphere of civil aviation (further – the service provider) to the operator of the airport (airfield) (further – uslugopoluchatel) according to these rules.

4. The certificate of service of aviation safety of the airport (airfield) (further – the Certificate) is inaliennable and is not transferred to other person.

5. The certificate is issued for a period of 3 (three) with indication of effective period.

6. The certificate confirms compliance of uslugopoluchatel to the established certified requirements.

7. For certification of service of aviation safety of the airport (airfield) the payment according to the procedure and the size which are determined by orders of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of March 24, 2023 No. 177 "About approval of Rules of collection of payments in the sphere of civil aviation of the Republic of Kazakhstan" is levied (it is registered in the Register of state registration of regulatory legal acts No. 32120) and the Minister of the industry and infrastructure development of the Republic of Kazakhstan of March 17, 2023 No. 167 "About approval of the list of paid services of authorized organization in the sphere of civil aviation and rates of payments in the sphere of civil aviation" (it is registered in the Register of state registration of regulatory legal acts No. 32089).

The state service is rendered after receipt of payment in the budget of the service provider.

8. Aggregate term of certification constitutes 17 (seventeen) working days.

9. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the order of the acting minister of transport and communications of the Republic of Kazakhstan of June 14, 2013 to No. 452 "About approval of Rules of entering of data into information system of monitoring of rendering the state services on stage of rendering the state service" (it is registered in the Register of state registration of regulatory legal acts for No. 8555).
