According to the subitem 5) of Item 1 of article 7 of the Law of the Republic of Kazakhstan of February 11, 1999 "About quarantine of plants" I ORDER:

1. Approve the enclosed phytosanitary requirements imposed to the imported quarantine products.

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising Vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The phytosanitary requirements imposed to the imported quarantine products

1. General provisions

1. These phytosanitary requirements imposed to the imported quarantine products (further - Phytosanitary requirements), are developed according to the subitem 5) of Item 1 of article 7 of the Law of the Republic of Kazakhstan of February 11, 1999 "About quarantine of plants" and determine requirements to the imported quarantine products (grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion, landing or seed material, fruits, vegetables, fruit, potatoes on the food and (or) technical purposes, cuts of fresh flowers, pottery plants, pincers, nematodes, live insects for the research purposes, wood, packaging and fixing materials), including to its packaging, disinfecting and transportation, for the purpose of providing quarantine of plants.

2. Types of quarantine products are identified according to the commodity nomenclature of foreign economic activity of the Eurasian Economic Union.

3. The quarantine products imported on the territory of the Republic of Kazakhstan shall be free from the quarantine objects specified in the List of quarantine objects and alien types in relation to which actions for quarantine of plants are established and performed approved according to the subitem 8) Item 1 of article 7 of the Law of the Republic of Kazakhstan of February 11, 1999 "About quarantine of plants" (further - the List of quarantine objects).

4. The list of the countries from which import to the territory of the Republic of Kazakhstan of quarantine products is performed is established according to appendix to these Phytosanitary requirements.

In case of import to the territory of the Republic of Kazakhstan of quarantine products from the country which is not included in appendix to these Phytosanitary requirements, the owner of products provides compliance of quarantine products to these Phytosanitary requirements.

2. Phytosanitary requirements to grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion

5. The imported grain, leguminous, oil-bearing, forage, commercial crops:

1) torments and grain shall be directed to conversion and (or) storage, except for;

2) in case of detection of the Indian smut of wheat are liable to return or destruction;

3) in case of identification of quarantine objects for the choice of the owner are liable to disinfecting or destruction, and in case of refusal the owner or impossibility of performing disinfecting or destruction - to return.

7. Waste of grain, leguminous crops:

8. Transportation of grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion on the territory of the Republic of Kazakhstan is performed in holds of courts, containers, cars with providing measures for exception of pro-rashes.

Grain, leguminous, oil-bearing, forage, commercial crops from the companies performing their storage on processing enterprises are transported by road transport in all-metal reservoirs, including containers.

9. When importing to the territory of the Republic of Kazakhstan of grain, leguminous, oil-bearing, forage, commercial crops in the packaged type the container shall be gas-permeable.

10. When unloading grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion from holds of courts the technical means excluding pro-rashes on surface of the water are used.

Unloading of grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion from vehicles is performed only on hard-standing spaces (concrete, asphalt).

Malt unloading by origin from the countries of distribution of kaprovy bug from vehicles in Items of its appointment is performed only after carrying out the state control and supervision in the field of quarantine of plants of vehicles and performing obligatory disinfecting.

11. The pro-rashes of grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion which are formed on unloading platforms and railway tracks are subject to daily removal and cleaning.

12. The vehicles, reservoirs, storage facilities and the equipment used for storage, transportation, conversion of grain, leguminous, oil-bearing, forage, commercial crops and products of their conversion are subject to cleaning with destruction of waste, and in case of need - fumigation.

13. Grain, leguminous, oil-bearing, forage, commercial crops arrive on storage and conversion in the storage facilities which are subject to disinfecting at least once a year.

3. Phytosanitary requirements to landing or seed material

14. Landing or seed material shall have:

1) phytosanitary certificate of national quarantine services of exporting countries;

2) marking with information on product name, the country of its origin, the exporter and (or) reexporter, the place and (or) the site of production;

3) initial packaging before completion of the procedure of the state control and supervision in the field of quarantine of plants.

15. Landing or seed material before receipt of results of laboratory examination is not used. Before completion of laboratory examination landing or seed material shall contain in the conditions excluding distribution of quarantine objects.

16. The samples which passed the laboratory examination do not return to the owner of products or his representative, except for the samples which are of special scientific or other value according to the address of their owners.

17. Batches of seed material of potatoes shall be packed into new container.

18. Landing material of pottery plant or plant with the closed root system shall be imported on the territory of the Republic of Kazakhstan in nutritious substrate, free from quarantine objects.

19. On the territory of the Republic of Kazakhstan plants with the radical soil are not imported.

20. Landing material of decorative, fruit and berry cultures (except wild strawberry) and grapes shall be at rest, without leaves, flowers and fruits.

21. Batches of the imported landing or seed material in which quarantine objects are revealed at the choice of the owner are liable to disinfecting or destruction, and in case of refusal the owner or impossibility of performing disinfecting or destruction - to return. At the same time only the infected part of batch is subject to disinfecting, destruction or return.

The landing or seed material infected with quarantine objects, which is of special scientific or other value according to the address of its owner can be transferred for research to introduktsionno-quarantine nursery. 22. Seed material of potatoes shall be made in zones, places and (or) sites of production, free from causative agents of the mushroom, bacterial, phytoplasma, viral and nematodny diseases included in the List of quarantine objects that shall be confirmed by the relevant information in the Section of the phytosanitary certificate "Additional declaration".

23. Landing material (stocks and shanks of seeded, stone and nuciferous cultures) shall be free from wreckers of plants, causative agents of the mushroom, bacterial, phytoplasma, viral and nematodny diseases included in the List of quarantine objects and is grown up in zones, places and (or) sites of production, free from them, that shall be confirmed by the relevant information in the Section of the phytosanitary certificate "Additional declaration".

24. Crops (landings) made by import landing or seed material are subject to annual inspection. Accomplishment of these works is provided with physical persons and legal entities according to instructions of the state inspectors on quarantine of plants.

25. Transportation of landing or seed material is performed in packaging with providing measures for exception of pro-rashes.

4. Phytosanitary requirements to fruits, vegetables, fruit and potatoes on the food and (or) technical purposes

26. Fruits, vegetables, fruit and potatoes shall have:

1) marking with information on product name, the country of its origin, the exporter and (or) reexporter, the place and (or) the site of production;

2) initial packaging before completion of the procedure of the state control and supervision in the field of quarantine of plants.

27. If in the sample (samples) of fruits, vegetables, fruit and potatoes which is selected from batch quarantine objects are found, this batch at the choice of the owner is liable to disinfecting or destruction, and in case of refusal the owner or impossibility of performing disinfecting or destruction - to return. At the same time only the infected part of batch is subject to disinfecting, destruction or return.

28. Soil impurity in potatoes and (or) other klubneplodny and rhizocarpous vegetables shall not exceed 0,5 of percent from products weight.

29. When importing fruits, vegetables, fruit and potatoes the laying from materials of plant origin is not used.

30. Transportation of fruits, vegetables, fruit and potatoes is performed in packaging with providing measures for exception of pro-rashes.

At the same time different types of fruits, vegetables, fruit are packed into different packagings.

5. Phytosanitary requirements to cuts of fresh flowers and pottery plants, pincers, nematodes and live insects for the research purposes

31. Cuts of fresh flowers and pottery plants shall have:

1) marking with information on product name, the country of its origin, the exporter and (or) reexporter, the place and (or) the site of production;

2) initial packaging before completion of the procedure of the state control and supervision in the field of quarantine of plants.

32. The batch of cuts of fresh flowers and pottery plants infected with quarantine objects at the choice of the owner is liable to disinfecting or destruction, and in case of refusal the owner and impossibility of performing disinfecting, destruction - to return. At the same time only the infected part of batch is subject to disinfecting, destruction or return.

33. The zone, the place and (or) the site of production of chrysanthemums (Chrysanthemum, Dendranthema), shall be free from the activator of askokhitoz of chrysanthemums Didymella ligulicola (K.F. Baker, Dimock & Davis) von Arx and the activator of white rust of chrysanthemums Puccinia horiana P. Henn., what shall be confirmed with authorized body of the exporting country by results of inspections within three years preceding shipment. In the Section "Additional Declaration" of the phytosanitary certificate the corresponding entry is made.

34. Pincers, nematodes and live insects for the research purposes shall be packed in special containers (reservoirs) excluding their distribution along the line and to provide access of the air necessary for breath of insects.

6. Phytosanitary requirements to wood, packaging and fixing materials

37. The wood, packaging and fixing material imported on the territory of the Republic of Kazakhstan, including detail of the repaired wood, packaging and fixing material shall be:

1) are disinfected;

2) are marked;

3) okorena.

38. Humidity of wood, packaging and fixing material shall not exceed 20 percent.

39. In the absence of marking import of wood, packaging and fixing material is performed in the presence of the phytosanitary certificate and by results of the state control and supervision in the field of quarantine of plants.

40. The wood, packaging and fixing material which is subject to disinfecting, return or destruction shall be stored in the conditions excluding distribution of quarantine objects from the moment of their detection before application of the adequate phytosanitary measures.
