About approval of Rules of appointment and payment of special public welfare payment

According to Item 7 of Article 5 and Item 1 of article 6 of the Law of the Republic of Kazakhstan "About special public welfare payment in the Republic of Kazakhstan" and the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services" PRIKAZYVAYU:

1. Approve the enclosed Rules of appointment and payment of special public welfare payment.

2. To provide to department of the public assistance of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this order.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan of Zhakupova S. K.

4. This order becomes effective after day of its first official publication, except for parts five of Item 6 of Rules of appointment and the payment of special public welfare payment approved by this order which becomes effective since January 1, 2016.

Rules of appointment and payment of special public welfare payment

Chapter 1. General provisions

1. These rules of appointment and payment of special public welfare payment (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About special public welfare payment in the Republic of Kazakhstan" (further - the Law) and the Law of the Republic of Kazakhstan "About the state services" and determine procedure for appointment and payment of special public welfare payment.

2. In these rules the following basic concepts are used:

1) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services, services in issue of specifications on connection to networks of subjects of natural monopolies and services of subjects of the quasi-public sector according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services, services in issue of specifications on the connection to networks of subjects of natural monopolies, services of subjects of the quasi-public sector and issue of their results to uslugopoluchatel by the principle of "one window", and also ensuring rendering the state services electronically performing state registration of the rights to real estate in the place of its stay;

2) the special commissions - the commissions created by decisions of akims of the corresponding administrative and territorial units for establishment of length of service to persons who worked at least 6 months during the period from June 22, 1941 to May 9, 1945;

3) special public welfare payment (further - benefit) - the money payment, including electronic money, to the citizens having entitlement to benefit provided irrespective of other types of benefits;

4) the receiver of benefit (further - the receiver) - physical person which is granted allowance;

5) authorized organization for issue of benefit - the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company;

6) authorized body to destination benefits – territorial subdivision of Committee of work and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

6-1) person performing leaving – the physical person which is directly performing face care with disability of the first group irrespective of family relation with it;

7) division of medico-social examination (further - division of MSE) - the structural division of authorized body to destination benefits which is carrying out medico-social expertize;

8) departments of the State corporation - city, district departments of the State corporation;

9) branches of the State corporation - branches of the State corporation of area, the cities of republican value and the capital;

10) the state service - one of the forms of realization of the separate state functions performed in individual procedure according to the address or without address of applicants and directed to realization of their rights, freedoms and legitimate interests, provision of the corresponding material or non-material benefits by it;

11) No. 529 is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 29.12.2022

12) the applicant - the physical person addressing for purpose of benefit;

13) pro-active service - the state service rendered electronically, provided at the initiative of the subject of rendering services which rendering requires the obligatory consent of the subject of receipt of service provided by means of the subscriber structure of cellular communication;

14) the central executive body - the state body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the sphere of social protection of the population;

15) the web portal of "the electronic government" (further - the portal) - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

16) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

17) electronic prototype of case (further - EMD) - the electronic prototype of case of the receiver of benefit created by the State corporation.

3. To receivers to whom the allowance is granted till January 1, 2001 reassignment of benefit is made on the bases provided by the Law.

4. The benefit is paid monthly for current month and for observance of conditions on which the allowance is granted from the date of emergence of the right to its obtaining the sizes established by the Law.

In case of the death of the receiver, and also persons for whom leaving according to subitem 1-1) of article 1 of the Law is performed, the benefit is paid till month of death inclusive.

In case of departure of the receiver, and also persons behind which leaving according to subitem 1-1) of article 1 of the Law, on the permanent residence out of limits of the Republic of Kazakhstan is performed, allowance payment is made till month of departure inclusive.

In case of change of person performing leaving, the benefit is paid till day of change.

Chapter 2. Procedure for purpose of benefit from the republican budget

5. For purpose of benefit the applicant addresses to authorized body to destination of benefits (in case of primary establishment of disability), the State corporation, through the web portal of "the electronic government" (for receipt of information on the status of rendering the state service) or the subscriber structure of cellular communication with the statement in form 1 and 2 according to appendix 1 to these rules with application of documents, the documents and data specified in the list, claimed at uslugopoluchatel for rendering the state service, the list of the main requirements to rendering the state service "Purpose of Special Public Welfare Payment" (further – the list of the main requirements to rendering the state service) according to appendix 1-1 to these rules.

In case of primary establishment of disability of person, specified in subitems 1-3), 7), 8), 8-1) of Item 1 of article 4 of the Law, persons having the right to care according to subitem 1-1) of article 1 of the Law of purpose of benefit to person performing leaving in division of MSE at the place of residence with the statement in form according to appendix 3 to Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits on age, the public social benefits on disability on the occasion of loss of the supporter, the public special welfare payments, the approved order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 address for purpose of disability benefit, and also (it is registered in the Register of state registration of regulatory legal acts for No. 11110) (further - Rules No. 223).

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering and also other data taking into account features of provision of the state service is given in appendix 1-1 to these rules.
