About the state social order, the state order on realization of strategic partnership, grants and awards for non-governmental organizations in the Republic of Kazakhstan

This Law governs the public relations arising in implementation process of the state social order, state order on realization of strategic partnership, provision of grants and award of awards for non-governmental organizations in the Republic of Kazakhstan.

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) the social program - complex of the interconnected social projects;

1-1) social projects - set of the organizational, economic and technical measures directed to goal achievement in the socially important spheres which are implemented within one year and up to three years;

2) the state social order - form of implementation of social programs, social projects, the functions of the central and (or) local executive bodies transferred for implementation to competitive environment, directed to the solution of the tasks in the social sphere which are carried out by non-governmental organizations at the expense of budgetary funds;

3) tender on receipt of the state social order (further - tender) - the method of determination of the potential supplier directed to acquisition by the customer of works, services of non-governmental organizations and providing open and fair competition between potential suppliers of the state social order;

3-3) standards of the state social order - the regulatory legal acts establishing quality requirements, to conditions, content of the services rendered by non-governmental organizations and also criteria for evaluation of their quality;

4) the contract for implementation state social the zakazadogovor signed between the customer and the supplier according to the procedure, established by the legislation of the Republic of Kazakhstan;

4-2) forming of the state social order - planning process of subjects of the state social order according to competence of state body;

4-3) assessment of results of the state social order - efficiency analysis of implementation of the state social order;

5) the supplier of the state social order (further - the supplier) - the non-governmental organization realizing social programs, social projects for the contract for implementation of the state social order;

5-1) monitoring of implementation of the state social order - collection, processing and information analysis about implementation of the state social order;

5-2) forming of state grants - activities of state bodies for determination of the directions of state grants, holding procedure of annual and (or) mid-term planning and determination of budgetary funds for state grants;

5-3) efficiency evaluation of state grants - process of the analysis of the results received in the project progress, their compliance to effective objectives and the expected results;

5-4) strategic partner - the non-governmental organization which underwent competitive selection according to rules of implementation of the state order on realization of strategic partnership with which the contract for accomplishment of the state order for realization of strategic partnership is signed;

5-5) state order on realization of strategic partnership - the means provided to non-governmental organizations by the central executive bodies for the purpose of attraction of capacity of non-governmental organizations for realization of national priorities;

6) the customer - administrators of republican and local budget programs;

6-1) Coordination council on interaction with non-governmental organizations under authorized body (further - Coordination council) - the advisory advisory body created by authorized body for development of suggestions for improvement of interaction with non-governmental organizations;

7) non-governmental organization - the non-profit organization (except for political parties, labor unions and religious associations) created by citizens and (or) non-state legal entities on voluntary basis for achievement of common goals by them according to the legislation of the Republic of Kazakhstan;

7-1) grant for non-governmental organizations (further - grant) - the means provided to non-governmental organizations by the operator in the sphere of grant financing of non-governmental organizations for the purpose of support of citizens' initiatives, attraction of capacity of non-governmental organizations to the solution of topical issues of development of the social sphere;

7-2) monitoring of realization of grants for non-governmental organizations - collection, processing and information analysis about realization of grants for non-governmental organizations;

7-3) award for non-governmental organizations (further - award) - the monetary reward awarded at the expense of budgetary funds to non-governmental organizations for the made contribution to the solution of social tasks of republican, industry and regional levels;

7-4) operator in the sphere of grant financing of non-governmental organizations (further - the operator) - the non-profit organization in the form of joint-stock company determined by the Government of the Republic of Kazakhstan and having the right to provision of grants according to this Law;

7-5) The database of non-governmental organizations - the information database created for the purpose of ensuring transparency of activities of non-governmental organizations and informing the public on them and also for use within placement of the state social order, the state order on realization of strategic partnership, provision of grants and award of awards;

8) councils on interaction and cooperation with non-governmental organizations - the advisory advisory bodies created for development of suggestions for improvement of interaction and cooperation between state body and non-governmental organizations which part representatives of the interested state bodies and non-governmental organizations are;

8-1) authorized body in the sphere of interaction with non-governmental organizations (further - authorized body) - the state body performing management and cross-industry coordination in the sphere of interaction with non-governmental organizations;

9) the potential supplier - the non-governmental organization participating in tender.
