1. Approve the enclosed Rules of certification in the sphere of extralight aircraft.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. I reserve control of execution of this order.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification in the sphere of extralight aircraft

1. General provisions

1. These rules of certification in the sphere of extralight aircraft (further - Rules) are developed according to subitem 41-23) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for certification in the sphere of extralight aircraft.

2. The terms and determinations used in these rules:

1) the request - the written appeal of the applicant to authorized body in the sphere of civil aviation for passing of the procedure of certification;

2) the applicant - the physical person or legal entity which addressed to authorized body in the sphere of civil aviation for receipt of the certificate of the flight validity of the aircraft of extralight aircraft;

3) the flight validity - the technical condition of the aircraft corresponding to flight technical characteristics which ensure its safety and flight quality.

Certification of the flight validity of aircrafts of extralight aircraft and the flight validity of the aircraft of extralight aircraft which does not have the approved standard design is performed by authorized body in the sphere of civil aviation with involvement of the non-profit organizations uniting operators of aircrafts.

4. For check of technical condition and determination of the validity to flights of the aircraft of extralight aircraft the relevant non-profit organizations in coordination with authorized body in the sphere of civil aviation create the permanent technical commission on inspection of aircrafts of extralight aircraft (further - the technical commission).

The technical commission the skilled technical experts and pilots having practical experience at least five years in operation of aircrafts, specialists of the certified centers, research, assessment and other authorities in coordination with heads of these organizations are included.

5. For certification of the flight validity of the aircraft of extralight aircraft collection according to the procedure and the size determined by the Code of the Republic of Kazakhstan of December 10, 2008 "About taxes and other obligatory payments in the budget" (Tax code) is levied. Certification of the flight validity of aircrafts of extralight aircraft is performed after payment in the government budget of the specified collection.

2. Procedure for certification of the flight validity of the aircraft of extralight aircraft

6. Certification is performed in the following procedure:

1) the applicant submits to authorized body in the sphere of civil aviation the request in form according to appendix 1 to these rules. The following documents are enclosed to the application:

copy of the certificate of compliance of copy of the aircraft of extralight aircraft or certificate of type;

the copy of the document confirming payment of collection for certification of the flight validity of aircrafts of extralight aircraft.

2) conducting examination of operational technical documentation and determination of the flight validity of the aircraft;

The authorized body within five calendar days from the moment of registration of the request transfers the copy of the request of the technical commission for work on examination operational and technical and estimates of documentation of compliance with airworthiness standards of civil aircrafts.
