About some measures for accomplishment of the Law on theaters, circuses and the concert organizations

For the purpose of accomplishment of the Law on theaters, circuses and the concert organizations No. 1421-XV of October 31, 2002. (The official monitor of the Republic of Moldova, 2002, Art. No. 174-176, 1331) DECIDES: the Government

Approve:

Regulations on theaters, circuses and the concert organizations according to appendix No. 1;

Regulations on rules of maintaining the State register of cultural institutions and art according to appendix No. 2.

Regulations on theaters, circuses and concert organizations

I. General provisions

1. Theaters, circuses and the concert organizations are public cultural institutions and arts which in total perform professional creative activity, combining it with economic, scientific and technical and educational, for the purpose of creation and representation before public of performances, concerts, circus programs, and also carry out other cultural activities.

2. Theaters, circuses and the concert organizations can be repertoire and project organizations, and also can act as the host party. They can be both in subordination of the Ministry of Culture, and in municipal, departmental subordination, with assignment by it, proceeding from tasks, the national, republican, municipal and departmental status.

3. On the basis of the authorized capital invested by one or several legal entities or physical person private theaters, circuses and the concert organizations can be founded.

4. According to the status approved by the founder, theaters, circuses and the concert organizations can perform different types of activities: drama, musical and drama, comedy, musical, opera, concert, choreographic, circus, etc.

5. Theaters, circuses and the concert organizations are established by legal entities and physical persons and perform activities according to the current legislation, individual charters and regulations on functioning approved by the founder.

6. Financial and economic activities of private theaters, circuses and concert organizations are performed according to the current legislation.

7. Theaters, circuses and the concert organizations can work at self-financing conditions with compliance with the charter approved by the founder have seal with the name, have accounts on the single treasurer account of the Ministry of Finance. They provide property management and financial resources on the terms of transparency and according to the principles of fair management.

8. Candidates for executive positions (the CEO, the economic director, the artistic director) are offered and affirm the founder of theater, circus or concert organization.

9. All staff of theaters, circuses and concert organizations is employed according to their charter as the CEO (director) and the individual employment contract on competitive or not competitive basis is signed with each of them.

II. Theaters, circuses and concert organizations of national value

10. Theaters, circuses and the concert organizations which perform repertoire policy of the special importance for national cultural process are considered national, representing outstanding national and world highly artistic works in the spirit of the best domestic traditions which serve as esthetic and ethic and moral reference point for society.

11. The status of national institution is given and responds the order of the Government according to the offer of the Ministry of Culture, the creative unions and bodies of local public authority on the basis of the solution of the commission of experts created by the Ministry of Culture taking into account the following conditions and criteria:

a) availability of public property and valuable repertoire;

b) national importance;

c) respect for traditions of national school;

d) variety of genres in the repertoire;

e) highly artistic level of execution;

f) statement of national classical and modern works of at least 30 percent for one concert season;

g) standard of creative and art skill;

h) experience of activities of organization at least 25 years;

i) creation of creative troupe from outstanding actors, the famous masters of scene, owners of the state awards (at least 70 percent), including the veterans of scene working after retirement at least 5 years;

j) implementation of internal tours (at least 20 in year) with complete

submission of the repertoire in different settlements of the country on the basis of the program approved with the Ministry of Culture;

k) participation in national and international festivals and tenders and receipt of awards;

l) implementation of tours abroad.

III. System of theaters, circuses and concert organizations

12. For establishment or approval of system (network) of organizations or their resubordination the Ministry of Culture creates commission of experts and represents to the Government for approval network of national, state, municipal, departmental theaters, with provision of the corresponding statuses by it and appointment of the founder. The commission of experts performs activities on the basis of the regulations on it approved by the Ministry of Culture.

IV. Tasks and activities of theaters, circuses and concert organizations, including national

a) development and approval of the founder of the current and perspective cultural and educational strategy covering all categories and age of the audience;

b) promotion of the highly artistic repertoire which is based only on professionalism;

c) statement of 3-6 new performances throughout concert season;

d) representation at least 20 performances in month during the season which proceeds 9 months in the current year;

e) preparation and preserving the troupe created on the basis of professionalism, moral ethical principles;

f) development of the repertoire program on the basis of highly artistic classical and modern national and world dramatic art (literature) and music;

g) approval of own esthetic identity by combination of traditional and new currents and tendencies in theatrical, circus and musical art;

h) encouragement of creative youth through special projects;
