Regulations on procedure for appointment and payment of public welfare payments for special merits before the state

I. General provisions

1. This provision establishes procedure for appointment and payment of public welfare payments for special merits before the state according to the Law on veterans No. 190-XV of May 8, 2003 and part (4) article 22/5 of the Law No. 21/2013 on creative specialists and the creative unions.

1-1. The following monthly public welfare payments for special merits before the state are established:

a) monthly personal public welfare payment to persons having special merits before the state (further – personal benefit);

b) monthly allowance for special merits before the state for the spouse/spouse or the mother/father of persons who are posthumously awarded the order by "Ordinul Republicii" or the award "Stefan cel Mare" (further – benefit for special merits).

2. The right to personal benefit is had:

1) the receivers of the pensions or the public social benefits established according to the national legal system, entering one of the following categories:

a) persons awarded with the state awards based on the Law No. 1123/1992 on the state awards of the Republic of Moldova;

b) persons awarded with the state awards of the former USSR equated to the state awards of the Republic of Moldova by the Resolution of Parliament No. 533/1995 on the rights of the citizens of the Republic of Moldova awarded with the state awards of the former USSR;

2) receivers of the allowance for merits granted based on the Law No. 21/2013 on creative specialists and the creative unions, awarded the order "Ordinul Republicii", the citizens of the Republic of Moldova living in the territory of the Republic of Moldova which establishes pension entitlement or the public social benefit in other state;

3) the citizens of the Republic of Moldova awarded with the state awards based on the Law No. 1123/1992 on the state awards of the Republic of Moldova or awarded with the state awards of the former USSR equated to the state awards of the Republic of Moldova by the Resolution of Parliament No. 533/1995 on the rights of the citizens of the Republic of Moldova awarded with the state awards of the former USSR, being receivers of pension or the public social benefit, including in other states irrespective of, they live in the Republic of Moldova or not;

4) in departure from subitems 1), 2) and 3) the veterans of war specified in articles 7 and 8 of the Law No. 190/2003 on veterans, who are citizens of the Republic of Moldova, awarded with the state awards based on the Law No. 1123/1992 on the state awards of the Republic of Moldova or awarded with the state awards of the former USSR equated to the state awards of the Republic of Moldova by the Resolution of Parliament No. 533/1995 on the rights of the citizens of the Republic of Moldova awarded with the state awards of the former USSR whether have the right to personal benefit irrespective of are they receivers of pension or the public social benefit and whether they live in the Republic of Moldova or not.

For special merits persons who are citizens of the Republic of Moldova of spouses/spouses, posthumously awarded the order by "Ordinul Republicii" or the award "Stefan cel Mare", persons who were married to it on the date of his death, or being citizens of the Republic of Moldova the mother/father, posthumously awarded the order by "Ordinul Republicii" or the award "Stefan cel Mare" have entitlement to benefit.
