About approval of the Regulations on the National commission on heraldry

Based on Item j) article 88 of the Constitution of the Republic of Moldova and part (4) article 8 of the Law on public symbols

The president of the Republic of Moldova decides:

Art. 1. – Approve Regulations on the National commission on heraldry which are component of this decree.

Art. 2. – Recognize invalid Article 2 of the Presidential decree of the Republic of Moldova No. 415 of December 5, 1995 about the National commission on heraldry.

Regulations on the National commission on heraldry

Chapter I. General provisions

1. The regulations on the National commission on heraldry are developed according to article 8 of the Law on public symbols and establish procedure for the organization and functioning of the National commission on heraldry in case of the President of the Republic of Moldova (further – the Commission).

2. The commission is the national authority pursuing single state policy in the field of public symbols in the Republic of Moldova.

3. The commission in the activities is guided:

a) provisions of the Constitution of the Republic of Moldova, Law on public symbols and other legal acts, resolutions of Parliament, decrees and orders of the President of the Republic of Moldova, orders of the Government, Regulations on the General armorial of the Republic of Moldova, and also requirements of this provision;

b) scientific regulations of heraldry, veksillologiya, hymnology, sfragistika, faleristika, uniformistika and other related and related special historical subjects;

c) national traditions in the field of public symbols.

4. The commission in the activities cooperates with bodies of the public power, legal entities and physical persons in the country and with similar foreign authorities and the profile organizations, and also with the international organizations.

5. Activities of the Commission are financed from the means provided in the government budget for the Office of the President of the Republic of Moldova and provided with material and technical support of the Office of heraldry as a part of the Office of the President of the Republic of Moldova (further – heraldry Office).

6. The location of the Commission is the municipium of Chisinau.

Chapter II. Procedure for forming of the Commission

7. Numerical and the staff of the Commission, appointment of its chairman, vice-chairman and secretary are established by the presidential decree of the Republic of Moldova. The number of members of the commission odd – from 9 to 15 people. Members of the commission are selected and appointed from among acknowledged specialists in the field of heraldic sciences and arts (heraldry, veksillologiya, sfragistika, faleristika, uniformistika, etc.), historians, art critics, artists, lawyers, etc., according to the proposal of the State heraldic officer of the Republic of Moldova.

8. Management of the Commission is performed of the commission chairman who is helped with its activities by the vice-chairman.

9. The state heraldic officer of the Republic of Moldova, the secretary-heraldic officer and the artist-heraldic officer Kabineta of heraldry are competent members of the commission and cannot be appointed to the commission chairman's position.

10. Any member of the commission can be recalled by the presidential decree of the Republic of Moldova.

Chapter III. Main functions of the Commission

11. For realization of the tasks the Commission performs the following functions:

a) develops the offers concerning national policy in the field of public symbols;

b) will organize development of national symbols and prepares legislative offers on them;

c) establishes the national regulations and theoretical, technical and practical conditions concerning development, organization, registration, accounting and production of public symbols, and also their use, storages and promotions;

d) advises bodies of the public power, legal entities and physical persons for the purpose of observance of the national regulations and theoretical, technical and practical conditions concerning development, organization, registration, accounting and production of public symbols, and also their use, storage and promotion;

e) develops and approves provisions, instructions and other standard documents concerning public symbols;

f) draws the conclusions on projects of public symbols;

g) draws the conclusions on projects of provisions and instructions about use (reproduction, execution, etc.) of statutes of public symbols;

h) makes within the powers provided by the law decisions on registration of public symbols in the General armorial of the Republic of Moldova;

i) accepts within the powers and on the bases established by the law, decisions on removal from the address of public symbols;

j) carries out according to the petition heraldic, veksillologichesky, sigillografichesky, hymnologic, faleristichesky, uniformistsky and other examinations;

k) studies and masters national and international experience in area of public symbols;

l) establishes the relations of cooperation with similar foreign authorities and the profile organizations, and also with the international organizations within the powers;

m) performs also other functions provided by regulations in the field.

Chapter IV. Rights and obligations of the Commission

12. For the purpose of realization of the Commission functions has the following rights and obligations:

a) exercise control of correctness and accuracy of application and observance by bodies of the public power, legal entities and physical persons of provisions of the Law on public symbols and other regulations in the field;

b) inform competent authorities about need of taking measures to suppression of violations of procedure for use of public symbols and application of the sanctions established by the legislation;

c) conduct researches in the field of public symbols, publish materials and works of the scientific, pedagogical, popularizing, information or normative nature and to provide provision of consultations in the specialty in the field;

d) coordinate activities of creative workshops for development and production of public symbols;

e) organize various forms of education and enhancements of specialists in the field of public symbols;

f) request within the competence from bodies of the public power, legal entities and physical persons information, necessary for the organization of activities, obligatory for representation;

g) involve highly qualified specialists to implementation of theoretical and practical activities in the field of public symbols;
