About approval of the Regulations on procedure for the organization of professional training of the unemployed

1. Approve Regulations on procedure for the organization of professional training of the unemployed according to appendix.

2. To the Ministry of Labour, Social Protection and Family:

together with the Ministry of Public Education in 2-month time to provide development and approval of Methodical regulations of the organization and carrying out professional training of the unemployed;

by October 1, 2003 to provide:

training of the serving employment agencies of the population of areas, municipiums and ATO Gagauzia to application of the Regulations on procedure for the organization of professional training of jobless and Methodical regulations of the organization and carrying out professional training of the unemployed;

broad informing the population on procedure for the organization of professional training of the unemployed by means of the edition of booklets, the organization of broadcasts and meetings with the citizens who are in job search, the publication in accordance with the established procedure of the specified regulations.

3. Declare invalid the appendix N 2 to the Order of the Government of the Republic of Moldova N 995 of September 25, 1998 "About some measures for social protection and employment of the unemployed" (The official monitor of the Republic of Moldova, 1998, N 92-93, Art. 968).

Regulations on procedure for the organization of professional training of the unemployed

The regulations on procedure for the organization of professional training of the unemployed (further - provision) establish single procedure and conditions of the organization, carrying out and financing of rates of preparation, retraining and advanced training and other forms of professional training of the unemployed according to the Law N 102-XV of March 13, 2003 "About employment of the population and social protection of persons which are in job search" (further - the law).

I. General provisions

1. The main objectives of provision are:

assistance of social integration of the unemployed, combining their professional aspirations and requirements of the labor market;

preparation of the human resources capable to promote growth of competitiveness of labor power;

updating of knowledge and enhancement of professional training on the major and related activities;

the retraining caused by economic reorganization, social changes or changes of labor capabilities;

assimilation of the new advanced knowledge, modern methods and acceptances necessary for accomplishment of service duties.

2. Professional training of the unemployed is important link in the course of continuous personnel training of national economy and is performed on the basis of the agreements signed by structures of National employment agency of the population (further - the national agency), by means of:

educational institutions of the Ministry of Education;

educational institutions and centers of course training of other ministries, departments, patronage and labor unions;

state and private economic agents;

commercial associations and non-profit organizations.

3. Professional training of the unemployed includes elementary and continuous professional training.

Elementary professional training of the unemployed provides necessary preparation for receipt of the minimum professional skills for employment.

Life-long professional education provides to adult population enhancement of the acquired knowledge or receipt of new.

4. According to this provision professional competence means capability to perform necessary transactions on workplace at the high-quality level provided by standards of employment which is reached in the way:

professional training - complex of the professional skills allowing any person to perform specialized activities in the field of specific craft or profession;

occupational retraining - mastering knowledge specific to other profession or craft, excellent from earlier received;

advanced trainings - enhancement of professional skills in the same qualification.

5. Professional training of the unemployed can be realized according to the conditions provided by this provision, state or the private legal entities which are hereinafter referred to as with service providers on professional training.

Service providers on professional training shall have conditions for rendering these services and accomplishment of standards of professional training.

The training centers created according to the law state or private legal entities can be service providers on professional training also.

6. Forms of realization of professional training of the unemployed are:

the rates organized by service providers on professional training;

the rates organized by employers directly at own company;

other forms of professional training provided by the law.

7. Determination of crafts, specialties, positions and types of activity on which it is necessary to prepare, train or improve skills of the unemployed is carried out based on the documentary analysis and studying on specialties of need for personnel at the moment and prospect in this territory, and also according to special requests of economic agents or unemployed who wish to be engaged in business activity.

Professional training of the unemployed is provided on industries according to the demand and supply in the labor market which would allow graduates of rates to find a job or organize business activity.

8. The national agency creates databank of educational base for professional training of the unemployed.
