About procedure for issue and withdrawal of omissions on the right of extraordinary entrance to the territory of road check points

Based on part three of Item 7 of the Regulations on the mode at check points through Frontier of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of January 22, 2009 No. 70, the State boundary committee of the Republic of Belarus DECIDES:

1. Determine that:

1.1. Are issued by the state boundary committee (further - State frontier committee) the omission on the right of extraordinary entrance to the territory of road check points through Frontier of the Republic of Belarus (further if other is not established, - the omission):

to legal entities and physical persons (further - the omission on physical person);

to the legal entities and individual entrepreneurs performing the international freight transportation on one cargo vehicle (further - the omission on the cargo vehicle);

1.2. the interested person represents to State frontier committee for obtaining:

the omission on physical person - the statement and other documents specified in Item 19.1 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156, Item 14.6 of the list of the ministerial procedures performed by state bodies and other organizations for petitions from citizens, No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010;

the omission on the cargo vehicle - the statement and other documents specified in Item 19.4 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs;

1.3. application for receipt of the omission is issued in form according to appendix 1;

1.4. the omission are issued on forms in forms according to appendix 2;

1.5. the omission is filled in with hand-written method or with use of technical means (typewriters, computers), signed by the Chairman of State frontier committee and sealed with the image of the State Emblem of the Republic of Belarus.

When filling the omission with hand-written method record is made by legible handwriting ink or paste of black color. In case of use of technical means dye or powder shall be black color;

1.6. for issue of the omission the state fee is collected;

1.7. the decision on issue of the omission or refusal in its issue is accepted by the Chairman of State frontier committee or the First Deputy Chairman of State frontier committee.

In case of decision making about refusal in issue of the omission the applicant is notified on it according to the procedure, stipulated by the legislation on ministerial procedures;

1.8. in issue of the omission it can be refused the cases established by part four of Item 7 of the Regulations on the mode at check points through Frontier of the Republic of Belarus;

1.9. the omission is issued to the interested person or his representative to availability of the documents confirming its powers on receipt of the omission;

1.10. the issued omission is valid during the term of its action. For execution of the new omission the interested person sends the documents necessary for issue of the omission to State frontier committee;

1.11. the omission in case of loss is not recovered, the duplicate is not issued;

1.12. the omission is subject to withdrawal by authorized officers of bodies of the border service in the cases established by part five of Item 7 of the Regulations on the mode at check points through Frontier of the Republic of Belarus;

1.13. upon withdrawal of the omission, except for case of the termination of term of its action, officials of bodies of the border service draw up the statement of withdrawal of the omission on the right of extraordinary entrance to the territory of road check points (further - the act) in form according to appendix 3.

The first copy of the act is issued to person from whom the omission is withdrawn, the second within five working days goes together with the withdrawn omission to State frontier committee.

2. Declare invalid the resolution of the State boundary committee of the Republic of Belarus of May 31, 2010 No. 13 "About some questions of issue of omissions on the right of extraordinary entrance to the territory of road check points through Frontier of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2010, No. 184, 8/22604).

3. This resolution becomes effective after its official publication.
