I. General provisions

1. The regulations on procedure for transfer of the state companies, the organizations, organizations, their divisions, buildings, constructions of fixed assets and other assets (further - the Provision) are developed on the basis of the laws "About Property", "About the State Company", "About Privatization", "About local public authority" "About public property of administrative-territorial and other regulations for the purpose of streamlining of acceptance transfer of the state companies, organizations, organizations (daleepredpriyatiya), their divisions, and also certain buildings, constructions of fixed assets and other assets (further - separate objects) other assets.

2. The provision establishes:

1) the bases and procedure for transfer of the companies, their divisions, separate objects and other assets from public property of the state in property of administrative and territorial units

2) the bases and procedure for transfer of the companies, their divisions and separate objects within maintaining one body of public management (the ministry, the department equated to them the central industry governing body or body of local public authority), and also from maintaining one body of public management in maintaining other body of public management;

3) the bases and procedure for transfer of the companies, their divisions and separate objects from maintaining bodies of public management in property of labor unions, public, religious and other non-state organizations or companies with the mixed or private equity (further non-state structures) and from these non-state structures in public property;

4) special procedure for transfer to private property of the companies, their divisions and separate objects in the course of privatization.

3. The basis for transfer of the companies, their divisions and separate objects of other assets specified in subitems 1, 2 and 3 Items 2 this provision is the decision on transfer made by authorized body of management according to the procedure, established by this Provision and other regulations.

The decision on transfer can be combined with decisions on reorganization of bodies of public management or on creation, reorganization, sanitation or liquidation of the companies.

4. The property is transferred:

1) gratuitously - in the cases specified in subitems 1 and 2 of Item 2 this provision;
