According to Item 3 of article 84 of the Water code of the Republic of Kazakhstan of July 9, 2003, I ORDER:

1. Approve the enclosed Rules of development and approval of standard rates of maximum permissible harmful effects on water objects.

2. To provide to committee on water resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of development and approval of standard rates of maximum permissible harmful effects on water objects

Chapter 1. General provisions

1. These rules of development and approval of standard rates of maximum permissible harmful effects on water objects (further - Rules) are developed according to Item 3 of article 84 of the Water code of the Republic of Kazakhstan of July 9, 2003 and determine procedure for development and approval of standard rates of maximum permissible harmful effects (further - the standard rate of PDVV) on water objects.

2. Standard rates of PDVV on water objects are established for the purpose of maintenance of surface and underground water in the condition conforming to ecological and sanitary and epidemiologic requirements and applied to complex assessment of each type of economic activity on water object, proceeding from its purpose.

3. In these rules the following basic concepts are used:

1) harmful effects - impact of economic activity on water object from which violations of steady condition of ecosystem, considerable quantitative reducing or high-quality deterioration in condition of waters of specific water object, the pool or its part (site) result;

2) the standard rate of PDVV on water objects - the indicator of maximum permissible harmful effects of economic activity on water object approved in accordance with the established procedure which non-compliance can lead to irreversible violation of natural state of ecological system of water object or its part (site);

3) maximum permissible impact of economic activity on water object - limit of impact of economic activity (size of anthropogenous load) of water object in case of which the natural structure and normal functioning of ecological system remains and harm is not done to health of the population.

Chapter 2. Procedure for development and approval of standard rates of maximum permissible harmful effects

4. Standard rates of maximum permissible harmful effects on water objects are established proceeding from:

1) the maximum permissible size of anthropogenous loading which long impact will not lead to change of ecological system of water object;

2) the maximum permissible mass and concentration of hazardous substances which can arrive in water object and on its catchment area.

4-1. Taking into account requirements of item 4 of these rules, norms of PDVV on water objects when implementing economic activity are determined as:

1) maximum permissible withdrawal of water resource - the value expressed by the size of maximum permissible amount of withdrawal of drain from water object in unit of time in case of anthropogenous impact without damage to ecosystem;

2) maximum permissible intake of chemicals in water object - the value expressed by the maximum permissible mass and concentration of intake of harmful chemicals in water object in unit of time.

5. The procedure of development of standard rates of PDVV on water objects includes:

1) collection and the analysis of the available information on target use of water object, economic activity in its pool;

2) assessment of the current state of water object taking into account sanitary and epidemiologic, fishery and ecological requirements;

3) the quantity and quality characteristic of sources of impact on water object.

6. Standard rates of PDVV on water objects are developed by the scientific, specialized and project organizations having the right to carrying out scientific works and works in the field of environmental protection based on results of specially conducted scientific research, prospecting and project works.
