About measures for improvement of financial position of minor children which parents evade from payment of the alimony

For the purpose of improvement of financial position of children whose parents evade from payment of the alimony the Government of the Republic of Moldova decides:

1. Children whose parents obliged to payment of the alimony are searched by law-enforcement bodies by determinations of courts and resolutions of criminal prosecution authorities in connection with evasion from payment of the alimony criminal prosecution for making of crimes and on other bases, or serve sentence in correctional institutions where they have no earnings from which the alimony in the minimum size established by the law can be collected, or are on treatment in medical institutions without allowance payment on social insurance, in other cases when collection of the alimony is impossible for the reasons which are not depending on persons obliged to their payment have the right to benefits to families with children according to the current legislation.

During search of parents to make payment of funds for minor children for compensation of the additional expenses connected with exceptional circumstances (serious illness, the child's mutilation, etc.) in the complete size established by the judgment. The specified means to pay also in cases when decisions of the courts about collection of additional expenses cannot be performed for the reasons which are not depending on persons obliged to their payment.

Allowance payment during search of the parents evading from payment of the alimony is made on decision of the courts.

Allowance payment and funds for minor children for compensation of the additional expenses connected with exceptional circumstances is made at the expense of the outstanding amounts of the minimum sizes of the alimony and the specified means collected from parents (for persons evading from payment of the alimony - actually paid amounts of benefits and means) with charge of 10 percent on these amounts, and also due to assignments of 50 percent of the amounts of the state fee collected for annulment of marriage by courts and bodies of registry office.

2. Assign allowance payment and means for compensation of additional expenses, the stipulated in Item 1 this resolution, to social welfare institutions.

3. Determine that requirements about collection from the parents obliged to payment of the alimony, the amounts paid according to Item 1 of this resolution are equated in requirements for the alimony.

4. Funds for allowance payment and compensation of additional expenses for minor children during search of their parents obliged to payment of the alimony, and in other established cases are listed and accumulate on the special account of Social fund of the Republic of Moldova.

5. Impose on the Ministry of Finance control of the correct and timely receipt and expenditure of the money intended for allowance payment and compensation of additional expenses on minor children according to this resolution.

6. To the Ministry of Justice to strengthen control of activity of the courts on execution of judgments on collection of children maintenance and the organization of work on collection from the parents obliged to payment of the alimony, the amounts paid during their search, and in other established cases, with charge of 10 percent on these amounts.

7. Provide to the Ministry of Internal Affairs activization of search of persons evading from payment of the alimony.
