About questions of production organization of cars

For the purpose of creation of conditions for the organization in the Republic of Belarus I decide productions of cars:

1. Enable the realization of the investment project "Production Organization on Assembly of Cars for 2012-2030" (further – the investment project) including construction and commissioning of the plant on production of cars (further – the plant) and objects of internal and external engineering and transport infrastructure to it according to the investment agreement of April 17, 2012 No. ID-1042, the prisoner between the Republic of Belarus and BELAZ open joint stock company – managing company of BELAZ-HOLDING holding, joint private company of Soyuzavtotekhnologiya, joint private company "BELDZhI", Zhejiang Jirun Automobile Co., Ltd (People's Republic of China).

2. Determine:

the joint private company "BELDZhI" (further – SZAO "BELDZhI") enabling the realization of the investment project, the customer on designing, construction and picking of the plant and objects of internal engineering and transport infrastructure to it "on a turn-key basis" and also engineering services, land management and other works connected with construction of the plant;

the utility affiliated unitary enterprise "Management of Capital Construction of Borisovsky District" (further – the company "UKS of Borisovsky District") the customer on designing and construction of facilities of external engineering and transport infrastructure to the plant taking into account carrying out from the territory of building of engineering networks of the existing infrastructure to border of the parcel of land determined in subitem 6.1 of Item 6 of this Decree.

2-1. Objects of internal engineering and transport infrastructure to the plant after completion of their construction are subject to voluntary conveyance in accordance with the established procedure in state-owned property.

Objects of internal and external engineering and transport infrastructure to the plant are assigned on the right of economic maintaining (operational management) to the operational organizations without state registration as real estate units based on deeds of conveyance of the costs made during creation of objects of internal and external engineering and transport infrastructure to the plant and the documents confirming completion of their construction and compliance of the project documentation.

State registration of creation of the objects of internal and external engineering and transport infrastructure to the plant donated to the operational organizations according to part two of this Item, and also emergence of the rights, restrictions (encumbrances) of the rights to these objects is performed by the territorial organization for state registration of real estate, the rights to it and transactions with it based on the statement of the relevant operational organization, deeds of conveyance of the costs made during creation of objects of internal and external engineering and transport infrastructure to the plant and other documents determined by Council of Ministers of the Republic of Belarus.

3. Determine that:

3.1. the construction of the plant and objects of internal and external engineering and transport infrastructure to it is performed:

with the right of cutting down of wood and shrubby vegetation. At the same time the received wood is implemented in the procedure established by the legislation;

without compensation of the losses of agricultural and (or) forestry and landscape production caused by seizure of land from the farmlands, lands of forest fund for their use for the purpose of which are not connected with maintaining rural and (or) forestry, and also without implementation of the compensation payments of cost deleted, the replaced objects of flora and indemnification caused to legal entities of the state pattern of ownership by withdrawal or temporary occupation of the parcels of land, demolition of the real estate units located on them;

in parallel with development, examination and approval in accordance with the established procedure the necessary project documentation on each of stages of works on construction;

3.2. the parcels of land provided to the company "UKS of Borisovsky District" for construction of facilities of external engineering and transport infrastructure to the plant for construction of such objects are exempted from the land tax;

3.3. prior to the beginning of construction of the plant and objects of external engineering and transport infrastructure to it on the occupied parcels of land removal of fertile layer of earth with its use is made for the needs connected with construction of these objects, and other needs in coordination with Borisovsky and Smolevichsky district executive committees;

3.4. registration of materials on withdrawal of the parcels of land to SZAO "BELDZhI" and the company "UKS of Borisovsky District" is made along with performance of works on construction of the plant and objects of internal and external engineering and transport infrastructure to it;

3.5. on the basis of negotiations without carrying out the contract biddings (procedures of public procurements):

SZAO "BELDZhI" and the company "UKS of Borisovsky District" determine general project, general contract, engineering the organizations, and also suppliers of construction materials, production equipment and other organizations attracted to designing and construction of the plant and objects of engineering and transport infrastructure to it;

the general project organization and general contract organization determine respectively project and contract organizations;

3.6. the general project organization and other project organizations, general contract organization and other contract organizations, the engineering organization, other organizations participating in implementation of the investment project sign agreements (contracts) for construction of facilities of the real estate as a part of the plant and objects of internal and external engineering and transport infrastructure to it, performance of works, rendering services and delivery of goods for construction and equipment of such objects;

3.7. No. 265 is excluded according to the Presidential decree of the Republic of Belarus of 08.07.2021

3-1. Exempt till July 1, 2019:

3-1.1. from taxation by import customs duties (taking into account the international obligations of the Republic of Belarus), and also the value added tax levied by customs authorities, the raw materials and materials (further - goods) which are not made in the territory of the Republic of Belarus and imported on this territory for exclusive use in this territory for the purpose of implementation of the investment project.
