About some questions connected with change of the administrative-territorial device of the Republic of Belarus

For the purpose of establishment of the single mechanism of creation, reorganization, liquidation of local councils of deputies, executive and administrative organs and the solution of other questions connected with change of the administrative-territorial device of the Republic of Belarus I decide:

1. Approve the enclosed Regulations on procedure for creation, reorganization, liquidation of local councils of deputies, executive and administrative organs and solutions of other questions connected with change of the administrative-territorial device of the Republic of Belarus.

2. The property belonging on the property right to the abolished administrative and territorial units of certain territorial level in case as a result of such abolition local councils of deputies, local executive and administrative organs of certain territorial level are not effective, is transferred to the possession of administrative and territorial units of higher territorial level, except for property of the liquidated local executive and administrative organs, the satisfaction of requirements of creditors which remained later subject to transfer to higher local executive and administrative organ (concerning regional, Minsk city executive committees - to the state body authorized by the President of the Republic of Belarus) if other is not determined in the decision on liquidation of local executive and administrative organ.

The property belonging on the property right to the abolished administrative and territorial units in case such abolition is resulted by their separation into two and more parts with their inclusion in structure of the territories of other administrative and territorial units, is transferred to the possession of these administrative and territorial units, except for property of the liquidated local executive and administrative organs, the satisfaction of requirements of creditors which remained later subject to transfer to higher local executive and administrative organ (concerning regional, Minsk city executive committees - to the state body authorized by the President of the Republic of Belarus) if other is not determined in the decision on liquidation of local executive and administrative organ.

The property belonging on the property right to the abolished administrative and territorial units in case as a result of such abolition in this territory administrative and territorial units are formed, is transferred to the possession of educated administrative and territorial units.

The property belonging on the property right to the united administrative and territorial units is transferred to the possession of the administrative and territorial unit occupying the territories of these administrative and territorial units as a result of consolidation.

The property belonging on the property right to administrative and territorial units which borders change without education, abolition or consolidation of administrative and territorial units is transferred to the possession of the administrative and territorial units of this territorial level occupying this territory as a result of change of borders, except for the property which is under economic authority of municipal legal entities.

3. The Council of Ministers of the Republic of Belarus, local executive and administrative organs along with introduction according to the President of the Republic of Belarus, local councils of deputies of offers on education, abolition of administrative and territorial unit, consolidation of administrative and territorial units, change of borders of administrative and territorial units make in the procedure established by the legislation offers on refining of separate indicators of the republican budget or modification and (or) amendments in the decision of local council of deputies on the budget for the current financial year regarding establishment (change) of standard rates of assignments from the regulating income and amounts of the interbudget transfers transferred (which are subject to transfer) to budgets of administrative and territorial units in connection with education, abolition of administrative and territorial unit, consolidation of administrative and territorial units, change of their borders.

In case of abolition of administrative and territorial unit taxes, charges (duties), and also other obligatory payments in the budget, including in the state trust budget funds which are subject to transfer in its budget are enlisted in budgets of the administrative and territorial units (the budget of administrative and territorial unit) occupying (occupying) the territory of the abolished administrative and territorial unit.

In case of consolidation of several administrative and territorial units taxes, charges (duties), and also other obligatory payments in the budget, including in the state trust budget funds which are subject to transfer in their budgets are enlisted in the budget of the administrative and territorial unit occupying the territories of these administrative and territorial units as a result of consolidation.

In case of change of border of administrative and territorial unit taxes, charges (duties), and also other obligatory payments in the budget, including in the state trust budget funds received in the territory within the changed borders are enlisted in the budget of the administrative and territorial unit occupying this territory as a result of change of borders.

4. Declare invalid the Presidential decree of the Republic of Belarus of September 29, 1998 No. 468 "About approval of the Regulations on procedure for the solution of the questions connected with consolidation of the administrative and territorial units of the same name having the general administrative center" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1998, No. 28, the Art. 713).

5. To Council of Ministers of the Republic of Belarus in three-months time:

introduce in accordance with the established procedure in the House of Representatives of National assembly of the Republic of Belarus the bill of the Republic of Belarus providing reduction of legal acts in compliance with this Decree;

provide reduction of acts of the legislation in compliance with this Decree;

take other measures for implementation of this Decree.

6. This Decree becomes effective in the following procedure:

Item 5 - after official publication of this Decree;

other provisions of this Decree - in three months after its official publication.
