About technology accession of electroinstallations

For the purpose of creating favorable conditions for implementation of business activity:

1. Determine that:

1.1. technology accession of electroinstallations of legal entities, individual entrepreneurs to the power networks which are in property of the Republic of Belarus and assigned on the right of economic maintaining to the power supplying organizations - the republican unitary enterprises of power industry which are part of the national production association of power industry of Belenergo (further - the power supplying organizations), is performed by the power supplying organization for the principle "one window" based on the statement of the legal entity, the individual entrepreneur on technology accession of electroinstallations to power networks.

For the purposes of this Decree technology accession of electroinstallations to the power networks performed by the power supplying organizations for the principle "one window" (further - technology accession), is understood as complex of the actions necessary for possibility of giving of electrical energy (capacity) from power networks of the power supplying organizations by tension of 0,4-10 of kilovolts inclusive on introduction distributing devices of electroinstallations of legal entities, individual entrepreneurs capacity to 250 kilovolt-amperes (230 kilowatts) inclusive which provides preparation of specifications, development on their basis of the project documentation, accomplishment of prospecting, construction, installation and other works, direct connection of the specified introduction distributing devices to power networks of the power supplying organizations, receipt of the permissions and (or) approvals provided by acts of the legislation, necessary for technology accession;

1.2. technology accession is performed in case of:

connection of introduction distributing devices of the electroinstallations which are again put into operation;

increase permitted to capacity utilization of earlier attached electroinstallations;

change of the scheme of external electric utility service of electroinstallations, including category on reliability of electric utility service of electroinstallations and points of connection of introduction distributing devices of electroinstallations.

When implementing technology accession development of preproject (pre-investment) documentation, and also availability is not required from the power supplying organization of the certificate of compliance, provided by the Presidential decree of the Republic of Belarus of January 14, 2014 No. 26 "About measures for enhancement of construction activities" (The national legal Internet portal of the Republic of Belarus, 17.01. 2014, 1/14755);

1.3. technology accession is not performed in case of construction:

the objects of engineering infrastructure financed from republican and (or) local budgets including for areas of the housing estate;

the generating sources, including renewable energy resources;

1.4. technology accession is performed on the conditions determined by the power supplying organization and the legal entity, the individual entrepreneur in the agreement on technology accession of electroinstallations to power networks which compulsory provision for the conclusion is availability at the legal entity, the individual entrepreneur of the right certifying document on the parcel of land on which electroinstallations of the legal entity, the individual entrepreneur are located (or will be located).

The agreement specified in part one of this subitem shall contain the following essential conditions:

list of actions for technology accession;

term of technology accession;

obtaining by the power supplying organization of the permissions and (or) approvals necessary for technology accession, according to stipulated by the legislation ministerial procedures;

the amount of the payment for technology accession calculated by the power supplying organization according to the procedure determined by Council of Ministers of the Republic of Belarus and also procedure for its introduction;

differentiation of balance sheet accessory of power networks (electroinstallations) and operational responsibility of the power supplying organization and the legal entity, the individual entrepreneur;

1.5. when implementing technology accession the power supplying organization:

is interested person when implementing of the ministerial procedures provided by acts of the legislation;

if necessary by negotiations without carrying out the contract biddings, the biddings on purchase of goods in case of construction attracts contract organizations to accomplishment of project, prospecting, construction, installation and other works and conducts procurement of such works and goods necessary for technology accession, according to the legislation;

1.6. the capital structures (buildings, constructions) constructed when implementing technology accession arrive in property of the Republic of Belarus and economic maintaining the power supplying organization;

1.7. state registration of creation of capital structures (buildings, constructions) and emergence of the property right of the Republic of Belarus and the right of economic maintaining the power supplying organization on them is made according to the statement of the power supplying organization based on the certificate of balance sheet accessory and cost of capital structure (the building, construction).

2. Operation of this Decree does not extend to accession of electroinstallations of legal entities, individual entrepreneurs to which the power supplying organizations issue specifications on accession of electroinstallations by capacity to 250 kilovolt-amperes (230 kilowatts) inclusive to power networks tension of 0,4-10 of kilovolts inclusive before entry into force of this Decree.

3. To Council of Ministers of the Republic of Belarus in three-months time:

approve Regulations on procedure for the conclusion of the agreement on technology accession of electroinstallations to power networks, standard form of the agreement on technology accession of electroinstallations to power networks and the application form on technology accession of electroinstallations to power networks;

determine procedure for forming of payment for technology accession;

provide reduction of regulatory legal acts in compliance with this Decree and take other measures for its realization.

4. This Decree becomes effective in the following procedure:

Items 1 and 2 - in three months after its official publication;

other provisions of this Decree - from the date of its official publication.
