In pursuance of article 5 of the Law on veterans N 190-XV of May 8, 2003. (The official monitor of the Republic of Moldova, 2003, N 84-86, Art. 392) DECIDES: the Government

Approve Regulations on procedure for assignment of the status of the veteran of war and certification according to appendix.

Regulations on procedure for assignment of the status of the veteran of war and certification

I. General provisions

1. The regulations on procedure for assignment of the status of the veteran of war and certification (further - provision) are developed for the purpose of accomplishment of article 5 of the Law on veterans N 190-XV of May 8, 2003. (Official monitor of the Republic of Moldova, 2003, N 84-86, Art. 392).

2. This provision determines procedure for assignment of the status of the veteran of war, and also procedure for issue, accounting and storage of certificates of the veteran of war.

Earlier issued certificates are valid before certification of new type.

3. The status of the veteran of war is given:

1) to participants of war:

a) the serviceman passing military service in military divisions, parts, headquarters and military organizations which in the years of World War II or during other combat operations on protection of the former USSR were part of field army, and also to persons acting as a part of guerrilla groups;

b) to the military personnel who was involved in World War II as a part of the Romanian army and are citizens of the Republic of Moldova;

c) to civilian faces of Armed forces, law-enforcement bodies and state security agencies of the former USSR which in the years of World War II held established posts in the military divisions, parts, headquarters and military organizations which were part of field army;

d) to persons which were during World War II as a part of military divisions, parts, headquarters and the military organizations which were part of field army and fleet as to pupils of regiment or ship's boys;

e) to persons who in the years of World War II, being in structure of guerrilla groups, underground organizations and other anti-fascist forming, were involved in military operations against fascist Germany in the territories of other states;

f) to persons who were involved in fighting in Afghanistan and also in fighting in the territories of other states, from among the military personnel and civilians of the Soviet Army, Navy, the state security agencies, the staff of law-enforcement bodies of the former USSR; to the workers of these categories sent by public authorities of the former USSR to other states and who were involved in fighting in their territories (according to appendix to the Law on veterans N 190-XV of May 8, 2003);

g) the serviceman who is on active service, to the reservists called on charges, to the volunteers and the staff of law-enforcement bodies and penal system enlisted in states of the military units and special structures which were on fighting line items and also to military personnel, the staff of law-enforcement bodies and penal system and the civilians attached to these parts for the purpose of accomplishment of special tasks for ensuring effective fighting on protection of territorial integrity and independence of the Republic of Moldova;

2) to persons equated to participants of war:

a) to the military personnel including transferred to the reserve (resignation) and the civilians awarded with the medal "For Victory over Germany in the Great Patriotic War of 1941-1945." or the medal "For Victory over Japan", passing military service during the period from June 22, 1941 to September 3, 1945 in the military units, military organizations, military schools which were not part of field army;

b) to persons awarded with the medal "For Defense of Leningrad" and persons awarded with the sign "Resident of Besieged Leningrad" working at the companies in organizations and the organizations of the city of Leningrad during blockade from September 8, 1941 to January 27, 1944;

c) to the persons awarded with awards or medals for dedicated work in the years of World War II, who worked in the back during the period from June 22, 1941 to May 9, 1945 at least six months excepting the work period in temporarily occupied territories of the former USSR;

d) to persons which were involved by municipal authorities in collection of ammunition and military equipment, mine clearing of the territories and objects in the years of World War II and during the period after completion of fighting on protection of territorial integrity and independence of the Republic of Moldova;

e) to the being minor prisoners of the concentration camps, ghetto and other places of detention created by fascist Germany and its allies during World War II.

4. The status of the veteran of war is given to persons having this right based on the certificate of the veteran of war.

5. The status of the veteran of war is given from the date of certification of the veteran of war.

II. Procedure for issue, accounting and storage of certificates of the veteran of war

6. Certificates of the veteran of war are stored and issued to receivers by General staff of National army and its subordinated structures.

7. Certificates of the veteran of war are issued directly to the receivers responsible for accounting, storage and issue of these certificates.

8. Certification of the veteran of war is performed based on the application in person of the receiver in case of the presentation of the identity certificate and documents confirming the right to the certificate of the veteran of war (the statement from the personal record, the entries in the military ID certified by seal of military unit as a part of which the receiver was involved in fighting, or references from archive organization).

9. Account of certificates of the veteran of war is kept in the special numbered, sealed magazines certified by seal and the signature of the chief of General staff of National army or the chief of territorial subordinated structure.
