About refining of separate indicators of the republican budget for 2014

(Extraction)

1. Specify indicators of the republican budget for 2014 in part:

1.1. increases:

the extreme extent of deficit of the republican budget and financing of deficit of the republican budget (part two and third article 1 of the Law of the Republic of Belarus of December 31, 2013 "About the republican budget for 2014" (The national legal Internet portal of the Republic of Belarus, 02.01. 2014, 2/2093) (further - the Law) and appendix 1 to it) on 2 496 791 604, 4 thousand rubles according to appendix 1;

amount of the funds allocated to the Belarusian innovative fund from republican innovative funds (the paragraph third parts one of article 9 of the Law), taking into account the direction of remaining balance of means of the republican innovative funds formed for January 1, 2014 on 43 443 095 thousand rubles;

expenses of the republican budget on financing of road economy (without means of the state trust budget fund of national development) (article 11 of the Law and appendix 9 to it) on 3 600 000 thousand rubles according to appendix 2;

limit of the internal debt guaranteed by the Republic of Belarus (the paragraph third parts one of article 12 of the Law), for 9 trillion rubles;

1.2. reduction:

the income of the republican budget (Article part one 1, paragraph two of article 4 of the Law and appendix 2 to it) on 5 661 482 465, 8 thousand rubles according to appendix 3;

expenses of the republican budget for functional classification of expenses of the budget for Sections, subsections and expense types (Article part one 1, the paragraph third article 4 of the Law and appendix 3 to it) on 3 164 690 861, 4 thousand rubles according to appendix 4;

expenses of the republican budget on financing of the state investing program (without reserve fund of the President of the Republic of Belarus, means provided on financing of road economy) (the paragraph of the sixth article 4 of the Law) on 123 799 767 thousand rubles;

expenses of the republican budget on scientific, scientific and technical and innovative activities regarding implementation of innovative projects, the organization of activities and development of material and technical resources of subjects of innovative infrastructure in functional classification of expenses of the budget for Sections, subsections and expense types, the directions of use and managers of budgetary funds (the paragraph of the seventh article 4 of the Law and appendix 6 to it) on 124 178 607 thousand rubles according to appendix 5;

the means transferred from the republican budget to consolidated budgets of areas and the budget of Minsk (Item 1 of article 6 of the Law and appendix 7 to it) according to appendix 6;

the means of the republican budget provided on development of agricultural production, fish breeding and conversion of agricultural products (paragraph two of article 7 of the Law) on 248 582 064, 4 thousand rubles;

the income of republican innovative funds (paragraph two of part one of article 9 of the Law) on 232 538 098 thousand rubles;

expenses of republican innovative funds (paragraph two of part one of article 9 of the Law) taking into account the direction of remaining balance of means of these funds formed for January 1, 2014 on 137 518 994, 1 thousand rubles.

2. Determine that in 2014:

2.1. the funds of funds of the precautionary (preventive) actions for separate types of compulsory and voluntary insurance created in 2014 according to Item 66 of the Regulations on insurance activity in the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of August 25, 2006 No. 530 "About insurance activity" which are not used in 2014 are allocated for expenses of the republican budget (The national register of legal acts of the Republic of Belarus, 2006, No. 143, 1/7866; National legal Internet portal of the Republic of Belarus, 19.04. 2014, 1/14942);

2.2. The Ministry of Finance in the course of execution of the republican budget has the right to make changes to expenses of the republican budget for functional classification of expenses of the budget regarding assignments for compensation (compensation) and interest payment for use of bank loans in the expense limits on the specified purposes provided in the republican budget on other nation-wide questions, other questions in the field of agricultural industry, fuel and power, other questions in the field of the industry, constructions and architecture, other industries of national economy;

2.3. the income of local budgets in part can go to the expenses of local budgets approved according to the legislation:

the means received from holding auctions on the right of the conclusion of lease agreements of the parcels of land and auctions for sale of the parcels of land in private property;

payments for the right of the conclusion of lease agreements of the parcels of land and payment for the parcels of land provided in private property without holding auctions;

the means arriving from privatization of the premises which are under economic authority or operational management of local executive and administrative organs, other state bodies, other state organizations or under free use of the organizations of non-state pattern of ownership created as a result of privatization;

2.4. the subventions on financing of expenses on development of agricultural industry and fishing activities transferred in 2014 from the republican budget to consolidated budgets of areas regarding funds for compensation of rise in price of potash fertilizers go for compensation of rise in price of the potash fertilizers which are purchased in 2014 and for debt repayment on compensation of rise in price of the potash fertilizers delivered in 2013;

2.5. the means of local budgets provided on implementation of actions on development of agricultural production go for payment of allowances for the sold agricultural products in the amount of at least 50 percent of the budgetary funds provided on implementation of the current activities connected with agricultural production;

2.6. the remaining balance of means of republican innovative funds formed for January 1, 2014 in the amount 138 462 198, 9 thousand rubles is used according to appendix 7;

2.7. on the loans of banks attracted (attracted) by the organizations on reconstruction of molochnotovarny farms, including according to the procedure and on the conditions provided by the Presidential decree of the Republic of Belarus of June 20, 2011 No. 256 "About additional measures for implementation of state programs in the field of agricultural industry" (The national register of legal acts of the Republic of Belarus, 2011, No. 71, 1/12621), compensation in the second half of the year 2014 to the organizations of part paid (added) in 2011, 2012 and 2014 of percent (compensation of losses to banks) is made according to the decisions of Council of Ministers of the Republic of Belarus made in 2014 and regional, Minsk city, district, city (the cities of regional subordination) Councils of deputies or according to their order decisions of the relevant local executive and administrative organs in the amount of refunding rate of National Bank at the expense of means republican and local budgets in equal shares, and the percent paid (added) in 2013 - in the amount of refunding rate of National Bank at the expense of means of local budgets.

Provisions of part one of this subitem extend to the credit agreements existing in 2014 according to which compensation to the organizations of part of the paid (added) in 2011-2014 percent in accordance with the established procedure was not made (compensation of losses to banks).

If in the second half of the year 2014 compensation to the organizations of part paid (added) in 2011, 2012 and 2014 of percent (compensation of losses to banks) on the credits of banks specified in part one of this subitem was made at the expense of means of the republican budget in the amount of more than 50 percent of refunding rate of National Bank, the corresponding additional expenses of the republican budget are subject to return in 2014 at the expense of means of local budgets;

2.8. the structure of import customs duties, the special, anti-dumping and compensatory duties which arrived from state members of the Customs union according to international agreements (appendix 2 to the Law) joins the import customs duties which arrived from the Republic of Kazakhstan in the amount of 779 492 000 thousand rubles, the import customs duties which arrived from the Russian Federation in the amount of 8 050 000 000 thousand rubles, the special, anti-dumping and compensatory duties which arrived from the Republic of Kazakhstan in the amount of 4 714 073 thousand rubles, the special, anti-dumping and compensatory duties which arrived from the Russian Federation in the amount of 48 561 907 thousand rubles;

2.9. return of excessively paid income tax regarding assignments in the amount of 10 percent sent to innovative fund of the Industry ministry is performed due to the current receipts in innovative fund of the Industry ministry and at the expense of means of the republican budget;

2.10. for office use;

2.11. for office use;

2.12. for office use;

2.13. for office use;

2.14. for office use;

2.15. for office use;

2.16. for office use.

3. Determine that the means from collection of the state fee for issue of permission to the admission of the vehicle to participation in traffic which arrived in 2014 in local budgets and are not used on the purposes established in Item 7 of article 23 of the Law are transferred into the republican budget in the form of the interbudget transfers.

5. To the Ministry of Finance:

5.1. restructure the overdue debt of republican affiliated unitary production enterprise "Konus" of the republican unitary enterprise "Scientific and Practical Center of National Academy of Sciences of Belarus for Mechanization of Agricultural Industry" for return to the republican budget of budget advance formed for November 1, 2014 by increase in its authorized fund at the amount corresponding to this debt in the amount of 15 062 401, in 2 thousand rubles;

5.2. at the expense of the means of the republican budget provided on increase in share of the state in authorized funds (including share acquisition), investment of capital in securities (bonds) to contribute in 2014 100 000 000 thousand rubles in the form of money deposit in authorized capital of open joint stock company "The Spartak paper-mill, including for restructuring of part of the debt of this joint-stock company which is subject to return to the republican budget (including the state trust budget fund of national development), on the budget advances issued to this joint-stock company according to the Presidential decree of the Republic of Belarus of June 26, 2008 No. 353 "About technical retrofitting and reconstruction of open joint stock company "Spartak paper-mill (The national register of legal acts of the Republic of Belarus, 2008, No. 158, 1/9832), in the amount of 41 000 000 thousand rubles.

6. Provide in 2014 from means of the republican budget:

6.1. budget credits to regional budgets in the amount of 200 000 000 thousand rubles, including to the regional budget of the Brest region - 31 200 000 thousand rubles, Vitebsk - 65 700 000 thousand rubles, Gomel - 18 600 000 thousand rubles, Grodno - 35 600 000 thousand rubles, Minsk - 27 000 000 thousand rubles, the Mogilev region - 21 900 000 thousand rubles, for a period of up to January 1, 2018 with establishment of interest rate for use of them in the amount of 3 annual interest rates for providing financial support of agro-industrial complex to the organizations during creation of additional skoto-places on the operating pig-breeding complexes and commodity farms and completing by their livestock of pigs by provision to these organizations of the budget loans.

Return of the budget credits granted according to part one of this subitem is performed by quarterly equal shares since I quarter 2016.

In case of violation of terms of return of the budget credits established in part two of this subitem to charge penalty fee in the amount of the refunding rate of National Bank operating on the date of emergence of debt, from the date of, the approach of obligations following behind day on return of budget credits.

The budget loans specified in part one of this subitem are provided by regional executive committees to the organizations of agro-industrial complex without the available tax debt, to charges (duties), other obligatory payments in the budget (including in the state trust budget funds), in state non-budgetary funds, overdue debt on the credits of banks (on principal debt and percent on it) including issued under guarantees of the Government of the Republic of Belarus, local executive and administrative organs, which did not fulfill the obligations on the loans which are earlier issued from republican and local budgets, loans (including prolonged), to the performed guarantees of the Government of the Republic of Belarus, local executive and administrative organs, for a period of up to January 1, 2018 with return by quarterly equal shares since I quarter 2016 with establishment of interest rate for use of them in the amount of 3 annual interest rates.

Excess of limit of the deficit of consolidated budgets of areas established by the Law and limits of debt of local authorities and self-government of areas on the amount of the budget loans granted according to part one of this subitem is allowed in 2014;

6.2. the budget loan in the amount of 100 000 000 thousand rubles to Rechitsadrev open joint stock company with establishment of interest rate in the amount of 5 annual interest rates on use of it for financing of the investment project "Upgrade of production of wood-shaving plates on Rechitsadrev open joint stock company without the conclusion it with the state insurance company of the insurance contract of responsibility for violation of the agreement on conditions of issue and return of the budget loan.

Return of the budget loan granted according to part one of this subitem is made from January 31, 2018 to August 31, 2022 according to the schedule approved with the Ministry of Finance;

6.3. the budget loan in the amount of 75 000 000 thousand rubles to Borisovdrev open joint stock company with establishment of interest rate in the amount of 5 annual interest rates on use of it for financing of the investment project "Reconstruction and Development of Productions of Tiled Wood Materials and Logging with Implementation of Complex of Energy Saving Actions" without the conclusion it with the state insurance company of the insurance contract of responsibility for violation of the agreement on conditions of issue and return of the budget loan.

Determine that the loan is granted without debt of Borisovdrev open joint stock company on taxes, charges (duties), other obligatory payments in the budget (including in the state trust budget funds), in state non-budgetary funds (except for Social Security Fund of the population of the Ministry of Labour and Social Protection), on budget advances, loans (including prolonged), overdue debt on the credits of banks (on principal debt and percent on it) including issued under guarantees of the Government of the Republic of Belarus, local executive and administrative organs and also without failure to carry out of the obligations by this society on the performed guarantees of the Government of the Republic of Belarus, local executive and administrative organs.

To perform return of the budget loan from January 31, 2018 to August 31, 2022 with payment of 5 annual interest rates on use of it according to the schedule approved with the Ministry of Finance.

7. Make changes to the State investing program for 2014 approved by the Presidential decree of the Republic of Belarus of February 20, 2014 No. 70 (The national legal Internet portal of the Republic of Belarus, 22.02. 2014, 1/14822), having been reworded as follows table 1-9 according to appendices 8-16*.

8. To the Ministry of Finance in 2014 to bring as money deposit of the Republic of Belarus in authorized capital:

8.1. the republican unitary enterprise "Belarusian Nuclear Power Plant" of 35 995 thousand dollars of the USA at the expense of remaining balance of the means of the state trust budget fund of national development formed for January 1, 2014;

8.2. open joint stock company "The Belarusian development bank and reconstruction Belinvestbank of 70 000 000 thousand rubles at the expense of part of remaining balance of the means of the republican budget formed for January 1, 2014.

9. To provide to Council of Ministers of the Republic of Belarus till December 31, 2014 acceptance in property of the Republic of Belarus of the shares issued in connection with increase in authorized capital of open joint stock company "Spartak paper-mill according to subitem 5.2 of Item 5 of this Decree, and also open joint stock company "The Belarusian development bank and reconstruction Belinvestbank according to subitem 8.2 of Item 8 of this Decree.

10. Provide to local executive and administrative organs following the results of 2014 increase (education) in share of the corresponding administrative and territorial units in authorized capitals of economic societies at the amount of the funds allocated from local budgets for reconstruction of flax-processing plants with installation of high-productive lines of development of flax fiber.

Allocation of money is performed on condition of not distribution (not assignment) of the part of profit (dividends) received from the date of entry into force of decisions on provision to these economic societies of money before increase (education) in share of administrative and territorial units in their authorized funds.

11. This Decree becomes effective from the date of its signing and extends the action to the relations which arose since January 1, 2014.
