About rules of content and use in border area and borderland of aircraft

Based on part two of article 39 of the Law of the Republic of Belarus of July 21, 2008 No. 419-Z "About Frontier of the Republic of Belarus", subitem 7.4 of Item 7 of the Regulations on the Ministry of Defence of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 7, 2006 No. 719, the Ministry of Defence of the Republic of Belarus DECIDES:

1. Determine that:

1.1. the activities connected with use and (or) ownership (further - content) devices for flights in the atmosphere of Earth (further - aircraft), are not allowed:

in borderland, except for contents of the aircraft used for the benefit of bodies of the border service, other state bodies and the organizations in case of accomplishment of the tasks assigned to them and also in other cases, stipulated by the legislation;

within border area - the aircraft which are subject to state registration and are not registered in accordance with the established procedure in the corresponding state register of aircrafts;

1.2. physical persons (citizens of the Republic of Belarus, foreign citizens and stateless persons) and legal entities performing activities for content, and also accomplishment of flights (further – use) aircraft (further – users), prior to the beginning of and after the end of the period of content in border area of aircraft, except for model aircrafts, notify on it by phone (or personally) the person on duty on the nearest territorial authority of the border service;

1.3. users report the official accepting the notification specified in subitem 1.2 of this Item, the following information:

surnames, own names, middle names (if those are available), passport data, contact telephone numbers of the user and owner of the aircraft;

aircraft type, serial (serial) number, the state and (or) registration signs (in case of their availability);

the main flight technical characteristics (the maximum range, flight duration, the range of heights and speeds of flight, the maximum take-off mass, possibility of application of target loadings - photo, video, infrared, aero magnetic and other equipment);

the period of content of the aircraft in border area;

purpose of content and use of the aircraft in border area;

the reason of the termination of content of the aircraft in border area;

1.4. the users using aircraft in border area need to have in case of themselves and to show upon the demand of authorized officers of bodies of the border service and internal affairs the documents provided in article 37 of the Law of the Republic of Belarus "About Frontier of the Republic of Belarus", and also other documents, stipulated by the legislation;

1.5. within border area it is not allowed to leave aircraft out of the settlements located in border area, without notice the person on duty on the nearest division of territorial authority of the border service. In case of breakdown of the aircraft the users using it and living in limits of border area need to take measures for its evacuation to the settlement in the place of residence (stay), other users - out of limits of border area;

1.6. control of observance of procedure for content and use in border area and borderland of aircraft is performed according to the legislation;

1.7. in border area and borderland of aircraft users are made for violation of procedure for content and use responsible according to the procedure, established by the legislation.

2. This resolution becomes effective after its official publication.
