About approval of the Instruction about use of funds of the family capital for improvement of housing conditions

In pursuance of Item 2 of the resolution of Council of Ministers of the Republic of Belarus of February 24, 2015 No. 128 "About approval of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital", parts two of Item 34 and part one of Item 39 of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital approved by the resolution of Council of Ministers of the Republic of Belarus of February 24, 2015 No. 128, the Ministry of Architecture of the Republic of Belarus DECIDES:

1. Approve the Instruction about use of funds of the family capital for improvement of housing conditions it (is applied).

2. This resolution becomes effective after its official publication.

The instruction about use of funds of the family capital for improvement of housing conditions

1. This Instruction determines single questions of realization by citizens of the right to the one-time state support in form of non-cash provided according to Item 3 of the Regulations on one-time provision to families of non-cash in case of the birth (adoption, adoption) in 2015-2019 third or the subsequent children approved by the Presidential decree of the Republic of Belarus of December 9, 2014 No. 572, and parts one of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of September 18, 2019 No. 345 "About the family capital" (further - the family capital).

2. No. 104 is excluded according to the Resolution of the Ministry of Architecture of the Republic of Belarus of 16.12.2021

3. Means of the family capital can be used ahead of schedule (irrespective of time which passed from the date of purpose of the family capital) in the Republic of Belarus in full or in parts via bank transfer on the purposes provided in part two of Item 13 of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital by the direction them on:

construction (reconstruction) of the single-family apartment house, apartment in the apartment or blocked apartment house (further if other is not established, – premises) as a part of the organization of builders;

construction (reconstruction) of premises based on the agreement of creation of object of shared-equity construction;

construction (reconstruction) of the single-family apartment house, apartment in the blocked apartment house by economic or contract method;

acquisition of premises, including premises which construction was performed according to the state order;

acquisition of share (shares) in the property right to premises (except for premises which construction was performed according to the state order);

debt repayment on the credit, including preferential (including based on agreements on the translation of debt, on acceptance of debt on the loan), granted on construction (reconstruction) or acquisition of premises, share (shares) in the property right to it, and interest payment for use to them;

debt repayment on loan of the organization and interest payment for use of this loan granted on construction (reconstruction) or acquisition of premises, share (shares) in the property right to it.

4. After the expiration of 18 years from birth date of the child, in connection with the birth (adoption, adoption) of which the family acquired the right to purpose of the family capital, means of the family capital can be used in the Republic of Belarus in full or in parts via bank transfer according to Item 15 of the Regulations on procedure and conditions of appointment, financing (transfer), the order and use of means of the family capital by the direction them on:

the purposes specified in Item 3 of this Instruction;

capital repairs and reconstruction of premises, construction of engineering networks, construction of economic rooms and constructions (further, unless otherwise specified, – capital repairs of premises);

debt repayment on the credit, including preferential, provided on capital repairs of premises, and interest payment for use to them.

5. For early use of means of the family capital the citizen addresses to division of open joint stock company "Belarusbank savings bank, performing account transactions on accounting of bank deposits (deposits) "Family capital" of physical persons (further, unless otherwise specified, - division of JSC ASB Belarusbank), with the statement for the early order means of the family capital in form according to appendix 1.

When using means of the family capital after the expiration of 18 years from birth date of the child, in connection with the birth (adoption, adoption) of which the family acquired the right to purpose of the family capital, the citizen addresses to division of JSC ASB Belarusbank with the statement for the order means of the family capital after the expiration of 18 years from birth date of the child, in connection with the birth (adoption, adoption) of which the family acquired the right to purpose of the family capital, in form according to appendix 2.

6. With the statements specified in Item 5 of this Instruction, the citizen submits the identity document, and also the document confirming powers of the representative - in case of the address of the citizen with the statement through the representative, the copy of the decision (the statement from the decision) local executive and administrative organ about the order means of the family capital (including early), and also the following documents:
