About approval of the Regulations on procedure for development and approval of the list of economic agents - the companies of light industry and types of service rendered by them in the territory of the Republic of Moldova to applicants of customs regime of conversion on customs area, exempted from the VAT with the deduction right and about procedure for administration of the services rendered by these companies

In pursuance of Item g) article 104 of the Tax Code and for the purpose of creating favorable conditions for activities of the companies of light industry the Government DECIDES:

1. Approve according to appendix Regulations on procedure for development and approval of the list of economic agents - the companies of light industry and types of service rendered by them in the territory of the Republic of Moldova to applicants of customs regime of conversion on customs area, exempted from the VAT with the deduction right.

2. The list of the economic agents companies of light industry rendering services in the territory of the Republic of Moldova to applicants of placement of goods under customs regime of conversion on customs area is vised by the Ministry of Finance and, as necessary, other central bodies of public management, affirms the Ministry of Economy and Infrastructure with the subsequent publication as the Official monitor of the Republic of Moldova.

The subsequent amendments and changes will be made to the specified List according to the procedure, established in the Provision approved by Item 1 of this Resolution.

1. This provision determines the mechanism of development and approval of the list of economic agents - the companies of light industry and types of service rendered by them in the territory of the Republic of Moldova to applicants of customs regime of conversion on customs area, exempted from the VAT with the deduction right (further - the list). This provision extends to the types of activity connected with production of textile products, clothes, footwear and products from skin (codes of economic activity according to the Qualifier of types of economic activity of Moldova (2009) - groups (classes) 13.91; 14.1; 14.3; 14:20; 15:12; 15.2; 96. 01).

2. The list (in the form established in appendix to this provision) affirms and changes the order of the Minister of Economy and Infrastructure and includes both operating plants of industry of light industry, and newly created or reorganized.

3. For inclusion in the list economic agents submit to the Ministry of Economy and Infrastructure the following documents:

a) statement for inclusion in the list;

b) copy of the registration evidence / decision on registration of the economic agent;

c) ceased to be valid;

d) the copy of the act issued by Chamber of Commerce and Industry, confirming availability of the production capacities necessary for the company for implementation of the related activity;

e) copies of the service provision agreements in the territory of the Republic of Moldova signed with applicants of customs regime of conversion on customs area (with indication of their numbers).

Economic agents bear complete responsibility according to the current legislation for reliability of the provided information.

4. Applications of economic agents for inclusion in the list are considered by the Ministry of Economy and Infrastructure in 7-day time from the date of their representation.

5. After approval of the list the Ministry of Economy and Infrastructure provides to the State Tax Administration the additional information about participants of accomplishment of the above-stated contracts for the purpose of their administration.
