ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

of April 29, 2004 No. 449

About approval of lists of the positions and works occupied or which are carried out by workers with whom the employer can sign written agreements about complete individual or collective (brigade) financial responsibility, and also standard agreements about full financial responsibility

(as amended of the Order of the Government of the Republic of Moldova of 04.07.2016 No. 826)

According to Code regulations on the work Government DECIDES:

1. Approve:

The list of the positions and works occupied or which are carried out by workers with whom the employer can sign written agreements about complete individual liability for failure to provide of safety of the transferred values, according to the appendix N1;

The standard agreement about complete individual financial responsibility according to the appendix N 2;

The list of works in case of which accomplishment the complete collective (brigade) liability for failure to provide of safety of the transferred values, according to the appendix N3 can be established;

The standard agreement about complete collective (brigade) financial responsibility according to the appendix N 4.

2. The written agreement about full financial responsibility (individual or collective (brigade)) can be concluded by the employer with the worker who reached age of 18 years and holding position or performing the works connected directly with storage, processing, sale (delivery), transportation or use in the course of work of the values transferred to it.

3. The complete collective (brigade) financial responsibility can be imposed in case of collateral execution by workers of the separate work types connected directly with storage, processing, sale (delivery), transportation or use in the course of work of the values transferred to them when it is impossible to differentiate liability of each worker for damnification and to sign with it the agreement on complete individual financial responsibility.

The complete collective (brigade) financial responsibility is established by the employer in coordination with employee representatives. The written agreement about complete collective (brigade) financial responsibility is signed between the employer and all members of collective (crew).

4. Disputes (conflicts) arising in case of the conclusion, renewal, change, amendment, termination and agreement performance about full financial responsibility are considered as employment disputes (conflicts) and are permitted according to the Labor code.

5. Recognize invalid the Resolution of Council of Ministers of the Moldavian SSR N 387 of November 4, 1977. "About procedure for the conclusion of written agreements about full financial responsibility of workers and employees for failure to provide of safety of the values transferred to them for storage or for other purposes".

6. Along with entry into force of this resolution regulations according to the list given in appendix N 5, are not applied.

The list of the positions and works occupied or which are carried out by workers with whom the employer can sign written agreements about complete individual liability for failure to provide of safety of the values transferred to them

I.

Cashiers, controllers, cashiers (including seniors), and also other workers who are carrying out obligations of cashiers (controllers).

The heads, their deputies, specialists and other employees of bank, financial and credit institutes performing: transactions with cash liquidity, securities, precious metals, coins from precious metals and currency values; transactions on issue, accounting, storage, issue and destruction of bank cards; collector functions and transportation of money and other values (including drivers-collectors), and also other workers performing similar functions.

Directors, managers, administrators (including senior, main), other heads of the organizations and divisions (including sections, places of acceptance, departments, halls) trade, public catering, consumer services, hotels (campings, motels), their deputies, assistants, sellers, merchandisers of all specializations (including senior, main), and also other workers performing similar functions; chiefs (heads) of construction and erection shops, sites and other construction divisions, operators and masters (including senior, main) construction and installation works.

Managers, other heads of warehouses, storage rooms (Items, departments), pawnshops, left-luggage offices, other organizations and divisions for storage, processing, sale (delivery), transportation of values, their deputies; supply managers, commandants of buildings and other constructions, storekeepers; senior nurses of the organizations of health care, procurement and/or supply agents, freight forwarders on transportation, the drivers of automobile and cargo vehicles, heavy cargo vehicles and buses transporting values and other workers performing storage, processing, sale (delivery), transportation of values.

Managers and other heads of drugstores and other pharmaceutical organizations, departments, Items, divisions, their deputies, druggists of all qualifications, technologists.

Laboratory assistants, methodologists of departments, dean's offices, managers of sectors of libraries.

II

Works on acceptance and payment of all payment types; on implementation of calculations in case of sale (realization) of goods, products and services (with use or without use of cash registers, including through the seller, the waiter or the other person responsible for carrying out calculations); on production and storage of all types of tickets, coupons, subscriptions (including subscriptions and coupons on leave of food (food) and other documents intended for calculations for services.

The works connected with implementation: transactions with cash liquidity, securities, precious metals, coins from precious metals and currency values; transactions on issue, accounting, storage, issue and destruction of bank cards; collector functions and transportation of money and other values.

Works on purchase (acceptance), sale (leave, realization) of services, goods (products), preparation them to sale (leave, realization).
