About privatization of the state housing stock

This law determines legal, economic, social basis and procedure for privatization of the state housing stock in the territory of the Republic of Uzbekistan.

The introduction in the property rights to housing gives to citizens the chance to effectively make the investments in the real estate, to masterfully use, use and dispose of the housing.

Chapter I. General provisions

Article 1.

Privatization of the state housing stock (further - privatization) is understood as sale, including on preferential basis, or voluntary conveyance to citizens in property on voluntary basis of the apartments occupied by them or again built, houses (part of houses) of the state housing stock.

The state housing stock is the housing stock of local authorities of the government and housing stock which is under complete economic authority or operational management of state bodies, companies, organizations, organizations.

Article 2.

The legislation on privatization of the state housing stock consists of this Law and other acts of the legislation issued according to it.

Privatization of the state housing stock in the Republic of Karakalpakstan is regulated by the legislation of the Republic of Karakalpakstan.

Article 3.

The basic principles of privatization of the state housing stock are:

equal rights of all subjects of privatization of the Republic of Uzbekistan to participation in privatization of the state housing stock;

voluntary basis;

interrelation of privatization with the solution of housing problem;

combination of paid and non-paid nature;

social protection of citizens;

publicity, respect for social justice;

state and public control over privatization process.

Article 4.

1. Privatization of the state housing stock is performed in the way:

voluntary conveyance of apartments, houses (part of houses) to the categories of citizens determined by acts of the legislation of the Republic of Uzbekistan;

sales of the state apartments, houses (part of houses) to citizens and legal entities without nationality.

2. Sale of the state and privatized apartments, houses (part of houses) is performed according to the procedure, established by the Cabinet of Ministers of the Republic of Uzbekistan.

Article 5.

The right to privatization of the state housing stock is granted to citizens of the Republic of Uzbekistan only once.

Article 6.

Ownership, use of the parcels of land and the house adjoining territories in which the privatized apartment houses are placed are performed according to the procedure and on conditions, stipulated by the legislation about the earth.

Article 7.

The premises received by citizens in houses of the state housing stock as a result of demolition of apartment houses in connection with seizure of land for social needs if the monetary compensation was not paid to them for these houses, and also as a result of natural disasters, irrespective of time of provision of the apartment, are donated to these citizens or their heirs.

Article 8.

In case of the demolition of the apartment house, structures and constructions belonging to the citizens, after enforcement of this Law specified to citizens, members of their families, and also other persons who are constantly living and registered in this house the right at their choice is granted and by agreement of the parties on receipt of apartments it is non-paid or right on construction the relevant company, organization, the organization on the new place of the apartment house, structures and constructions and transfers by it in property, or compensation for the demolished apartment houses, structures and green plantings.

Article 9.

The companies, associations, the organizations are granted the right to repay fully or partially the loan or the credit for housing construction or privatization of apartments to the workers and pensioners.

Article 10.

The premises privatized by citizens in property in accordance with the established procedure are excluded from the state housing stock and are included individual housing stock.

Article 11.

For disabled, lonely aged persons, pensioners and members of their families if their average per capita income per month below 35,2 of percent from the minimum wage, and also the young families needing housing for the first time created which another are socially not protected of needy categories of citizens according to the list determined by the Cabinet of Ministers of the Republic of Uzbekistan under public authorities on places is created the municipal housing stock of purpose used on terms of the contract of hiring without the privatization right.

Chapter II. Objects and subjects of privatization

Article 12.

1. Treat subjects to privatization:

apartments of apartment houses and single-family houses (part of houses) used by citizens on terms of the contract of hiring;

not populated and exempted apartments, single-family houses (part of houses) after the end of their reconstruction, repair;

apartments in again built houses.

2. Premises of again entered state housing stock can be provided to citizens on hiring or in lease with the right of their subsequent privatization.

3. Privatizations are not subject:

house museums, and also the apartments and houses which are objects of material cultural heritage;

apartments in houses of the closed towns and objects;

rooms in hostels of bed type;

the apartments carried in accordance with the established procedure to unsuitable for accommodation;

office apartments, rooms (house);

apartments in which two and more employers, in the absence of the consent of all to privatization of the occupied apartment live.

Article 13.

1. Subjects of privatization are citizens of the Republic of Uzbekistan, other states, stateless persons which constantly live (are registered) in the territory of the Republic of Uzbekistan.

2. For provision of housing for the workers and pensioners of the ministry, department, the company, organization, the organization and other legal entities of the Republic of Uzbekistan, other states can redeem housing from the owner.

3. The citizens occupying premises in houses of the state housing stock according to the employment contract with the consent of all jointly the living full age members and other persons having the right to living space, these rooms having the right to acquire in property, including joint or equity, on the conditions provided by this Law.
