About approval of Rules of transfer of certification of keys of documentary information by the centers to certification center of the National Bank of Ukraine

According to Item 26 of Article 7, to article 56 of the Law of Ukraine "About the National Bank of Ukraine", to Articles 5, of 10, 14 Laws of Ukraine "About the digital signature", to the Procedure for obligatory transfer of documentary information approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2004 No. 1454 (with changes), for the purpose of enhancement of the legal basis of activities of certification center of the National Bank of Ukraine the Board of the National Bank of Ukraine decides:

1. Approve Rules of transfer of certification of keys of documentary information by the centers in certification center of the National Bank of Ukraine which are applied.

2. To department of information security (Lukyanov D. A.) bring contents of this resolution to the attention of banks of Ukraine for use in work.

3. The resolution becomes effective from the date of, its official publication following behind day.

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Smoliya Ya. V.

Rules of transfer of certification of keys of documentary information by the centers to certification center of the National Bank of Ukraine

I. General provisions

1. These rules 14 Laws of Ukraine "About the digital signature" and the Procedure for obligatory transfer of documentary information approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2004 No. 1454 are drafted according to Item 26 of article 7 of the Law of Ukraine "About the National Bank of Ukraine", Articles 5, of 10, (with changes).

2. In these rules the following basic concepts are used:

1) documentary information - information which is transferred to storage of certification center of the National Bank of Ukraine (further - Certification center) the center of certification of keys which underwent the procedure of registration and the open key in certification center (further - the Center) in case of the termination of activities of the Center showed. Documentary information consists of paper and electronic documents;

2) the electronic register of certificates of keys - unique registration certificate numbers of the open keys created by the Center according to requirements of the legislation of Ukraine in the sphere of the digital signature (further - the certificate of key), specification (details) of subscribers which is brought in appropriate certificates of keys, dates and time of the beginning and the termination of effective period of certificates of keys, dates, time and the reasons of cancellation, blocking and updating of appropriate certificates of keys;

3) electronic documents - certificates of keys, the electronic register of certificates of keys, electronic documents based on which certificates of keys of subscribers (if such method is provided by regulations of work of the Center), the certificate revocation list were created, cancelled, blocked and renewed;

4) the applicant of the Center - physical person which on legal causes acts on behalf of the Center under the organization and carrying out transfer of documentary information in certification center in case of the termination of activities of the Center;

5) paper documents - agreements based on which services of the digital signature, documents based on which the certificates of keys of subscribers certified in accordance with the established procedure copies of decisions (determinations) of the courts on indemnification caused owing to improper execution of the obligations by the Center, the registration certificate of the Center were created, blocked, recovered, cancelled were provided to subscribers.

Other terms in these Rules are applied in the values given in the Law of Ukraine "About the digital signature" and also regulatory legal acts of National Bank concerning application of the digital signature in bank system of Ukraine and subjects of money transfer.

3. These rules determine the mechanism of transfer of documentary information in certification center the Center in case of the termination of its activities.

The mechanism of transfer of the strengthened certificates of open keys, documentary information in certification center the center of certification of keys accredited in certification center in case of the termination of its activities is determined by the Procedure for obligatory transfer of documentary information approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2004 No. 1454 (with changes).

4. The purpose of transfer of documentary information is the possibility of verification of the digital signature imposed on the electronic document by signer which open key was attested in the Center that stopped the activities.

5. The certification center accepts documentary information free of charge.

6. The applicant of the Center in case of the appeal to certification center shall show the document proving his identity, and the power of attorney confirming its powers to act on behalf of the Center under the organization and carrying out transfer of documentary information in certification center, the head/deputy manager of the Center assured by the signature and impress of a seal of the bank/center that is separate legal entity (in the presence).
