About the State committee of judicial examinations of the Republic of Belarus

This Law determines legal and organizational basis of activities of the State committee of judicial examinations of the Republic of Belarus (further if other is not determined, – the State committee of judicial examinations), its main objectives and powers, and also legal status, guarantees of legal and social protection of his employees and faces of civil personnel.

Chapter 1. Basic provisions

Article 1. State committee of judicial examinations

The state committee of judicial examinations - centralized system of the state bodies performing according to legal acts of power in the sphere of judicial and expert activities.

The state committee of judicial examinations is paramilitary organization, has official heraldic symbols.

The state committee of judicial examinations submits to the President of the Republic of Belarus.

The organizations created according to the decision of the President of the Republic of Belarus can be under supervision of the State committee of judicial examinations.

Article 2. Legal basis of activities of the State committee of judicial examinations

The legal basis of activities of the State committee of judicial examinations is constituted by the Constitution of the Republic of Belarus, this Law, other laws, legal acts of the President of the Republic of Belarus, other acts of the legislation and the international agreements of the Republic of Belarus.

If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law are applied rules of the international treaty.

Article 3. Principles of activities of the State committee of judicial examinations

Activities of the State committee of judicial examinations are based on the principles:

legality;

respect for interests of the state, rights, freedoms and legitimate interests of the citizen, rights and legitimate interests of the legal entity;

objectivity, comprehensiveness and completeness of conducting judicial examinations, examinations (researches), examinations (further if other is not determined, – expert researches);

admissibility and reliability of the methods applied when carrying out expert researches;

independence of activities of other state bodies, political parties, other public associations and other organizations, officials when implementing the powers in the sphere of judicial and expert activities.

Article 4. Main objectives of the State committee of judicial examinations

The main objectives of the State committee of judicial examinations are:

realization of single state policy in the sphere of judicial and expert activities, including its scientific and methodical providing;

implementation of judicial and expert activities;

determination and realization of the main directions of enhancement of judicial and expert activities, implementation in practice of achievements of science and technology, positive experience, progressive forms and methods of the organization and carrying out expert researches;

the organization of preparation and training in educational programs of additional education of the adult persons intending to perform (performing) judicial and expert activities scientists within the competence;

the organization and development within the competence of international cooperation of the sphere of judicial and expert activities.

Article 5. Interaction of the State committee of judicial examinations with other state bodies, other organizations and citizens

The state committee of judicial examinations performs the activities in interaction with other state bodies and other organizations, including law enforcement agencies and other organizations of foreign states, the international organizations, and citizens according to legal acts and international treaties of the Republic of Belarus.

State bodies and other organizations within the competence render assistance to the State committee of judicial examinations in accomplishment of the tasks and functions assigned to it, including direct specialists for participation in work of the commissions of experts according to the procedure, established by the legislation.

When rendering assistance of judicial examinations to the State committee in accomplishment of the tasks assigned to it and functions of the organization of health care irrespective of patterns of ownership and departmental subordination shall:

perform all types of physical examination in out-patient and stationary conditions of persons sent them by the State committee of judicial examinations (the state organizations of health care - it is non-paid);

provide rooms, provide necessary conditions for execution by employees and faces of civil personnel of the service duties;

provide to court experts of the State committee of judicial examinations medical documents according to the procedure, established by the legislation.

Chapter 2. System of the State committee of judicial examinations

Article 6. System of the State committee of judicial examinations

The State committee of judicial examinations are a part of the system the following state bodies:

central office of the State committee of judicial examinations;

territorial authorities of the State committee of judicial examinations:

managements of the State committee of judicial examinations on areas and Minsk;

district (interdistrict), city, district (interdistrict) departments of the State committee of judicial examinations in Minsk.

Article 7. Central office of the State committee of judicial examinations

The central office of the State committee of judicial examinations heads system of the State committee of judicial examinations and exercises within the powers regulation and control in the sphere of judicial and expert activities, and also coordination of activities of other state bodies, other organizations and physical persons in this sphere.

The structure of central office of the State committee of judicial examinations includes head departments, managements, departments, sectors. In central office of the State committee of judicial examinations for the purpose of ensuring its activities and maintenance other structural divisions according to the legislation can be created.

The central office of the State committee of judicial examinations is legal entity, has seal and forms with the image of the State Emblem of the Republic of Belarus and with the name.

Article 8. Managements of the State committee of judicial examinations on areas and Minsk

Managements of the State committee of judicial examinations on areas and Minsk are directly subordinated to central office of the State committee of judicial examinations.
