About some questions of content and use of vehicles

Based on part one of article 39 of the Law of the Republic of Belarus of July 21, 2008 "About Frontier of the Republic of Belarus" in edition of the Law of the Republic of Belarus of January 10, 2015 the State boundary committee of the Republic of Belarus DECIDES:

1. Approve the enclosed Rules of content and use in border area and borderland of the motorized vehicles which are not subject to operation on roads and also floating objects.

2. This resolution becomes effective since July 23, 2015.

Rules of content and use in border area and borderland of the motorized vehicles which are not subject to operation on roads and also floating objects

1. These rules establish procedure for content and use in border area and borderland of the motorized vehicles which are not subject to operation on roads and also floating objects.

2. For the purposes of these rules the following terms and their determinations are used:

border area, borderland - in the values determined respectively by paragraphs to the thirteenth and fourteenth part one of article 1 of the Law of the Republic of Belarus of July 21, 2008 "About Frontier of the Republic of Belarus" in edition of the Law of the Republic of Belarus of January 10, 2015 (The national register of legal acts of the Republic of Belarus, 2008, No. 184, 2/1516; National legal Internet portal of the Republic of Belarus, 22.01. 2015, 2/2240);

the motorized vehicles which are not subject to operation on roads - motor-all-terrain vehicles (the four-wheel off-road motorized vehicles having landing and controls of motorcycle type), snowmobile, the ice yacht, the snowmobile, motor-sledge and other similar means, including individual construction;

floating object - in the value determined in the paragraph the nineteenth article 1 of the Code of inland water transport of the Republic of Belarus;

content of the motorized vehicles which are not subject to operation on roads and also floating objects - the activities connected with storage of the motorized vehicles which are not subject to operation on roads and also floating objects;

use of the motorized vehicles which are not subject to operation on roads and also floating objects - the activities connected using the motorized vehicles which are not subject to operation on roads and also floating objects for their direct assignment;

physical persons - citizens of the Republic of Belarus, foreign citizens and stateless persons.

3. If other is not established by these rules, content and use in border area and borderland of the motorized vehicles which are not subject to operation on roads, and also floating objects is performed according to the procedure, established by the legislation of the Republic of Belarus in the field of traffic and inland water transport.

4. Content and use in borderland of the motorized vehicles which are not subject to operation on roads and also floating objects, except for such means and objects belonging to bodies of the border service, other state bodies and the organizations, used in case of accomplishment of the tasks assigned to them is not allowed.

5. Use in border area of the motorized vehicles which are not subject to operation on roads, and also floating objects is performed during daylight hours, that is during period of time which begins with the sunrise and comes to an end from the sunset.

6. The physical persons using the motorized vehicles which are not subject to operation on roads and also floating objects in border area need to have in case of themselves and to show upon the demand of authorized officers of bodies of the border service and law-enforcement bodies documents, the stipulated in Article 37 Laws of the Republic of Belarus "About Frontier of the Republic of Belarus", and also to make necessary explanations concerning stay in border area and borderland.

The physical persons using the motorized vehicles which are not subject to operation on roads within border area need to have also in case of themselves the documents confirming right of possession, uses and (or) orders of such vehicle (the purchase and sale agreement, donations, leases, free use, rolling, the order for rendering household service in rolling, the reference accounts, the sales receipt, the power of attorney, etc.).

7. Within border area it is not allowed to leave the motorized vehicles which are not subject to operation on roads out of the settlements located in border area, without notice the nearest division of bodies of the border service. In case of breakdown of the motorized vehicle which is not subject to operation on roads, the physical person managing it and living in limits of border area needs to take measures to its evacuation to the settlement in the place of residence, other physical person - out of limits of border area.

8. Use on certain sites of border area of the motorized vehicles which are not subject to operation on roads, and also floating objects according to the solution of authorized officers of bodies of the border service can temporarily be limited or be prohibited:

when carrying out boundary searches (regime actions), transactions and other actions on Frontier of the Republic of Belarus;

when holding actions for providing emergency rules or warlike situation.

9. Control of observance of rules of content and use in border area and borderland of the motorized vehicles which are not subject to operation on roads, and also floating objects is performed within competence by bodies of the border service and law-enforcement bodies.

10. In border area and borderland of the motorized vehicles which are not subject to operation on roads and also floating objects physical persons are made for violation of procedure for content and use responsible according to the procedure, established by the legislation.
