1. Approve the enclosed Rules of use of the geological information which is in state-owned property, for educational, scientific, commercial purposes and export of geological information out of limits of the territory of the Republic of Kazakhstan.

2. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the Internet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of use of the geological information which is in state-owned property, for educational, scientific, commercial purposes and export of geological information out of the limits of the territory of the Republic of Kazakhstan (further - Rules) developed according to subitem 32-1) of article 20 of the Law of the Republic of Kazakhstan of June 24, 2010 "About subsoil and subsurface use" (further - the Law), determine procedure for use of the geological information which is in state-owned property (further - geological information) for educational, scientific, commercial purposes and export of geological information out of limits of the territory of the Republic of Kazakhstan.

Chapter 2. Procedure for use of the geological information which is in state-owned property, for educational, scientific, commercial purposes

2. Provision in use of geological information, except for the geological information specified in Item 3 of these rules is performed by authorized body on studying and use of subsoil (further - authorized body) who is keeper of geological information in the Republic of Kazakhstan.

3. Rules do not extend to the geological information containing the state secrets.

4. Geological information includes two main types: primary and secondary.

Treat primary geological information:

information on natural carriers (material information) provided by core of boreholes, tests of oil, water, gas, samples, tests and collections of stone material, shlifama, anshlifama, mineral solutions and powders;

information on artificial (paper and electronic) carriers, reflected in magazines of field observations and other documentation, including in magazines of approbation, analyses of tests, registration of geophysical observations.

Information obtained as a result of processing, interpretation, the analysis and generalization of primary information belongs to secondary geological information.

5. Primary and secondary geological information is provided in use:

in the form of duplicates of information on natural carriers and copies of documents;

by acquaintance without copying and withdrawal of geological information.

6. Geological information is provided in permanent or in temporary use. In temporary use geological information is provided to persons who are carrying out the works connected with geological studying of subsoil at the expense of means of the government budget.

Upon completion of works on the agreement on the state geological studying of subsoil at the expense of means of the government budget the user within 15 (fifteen) working days returns the geological information obtained in temporary use in authorized body.

In other cases geological information is provided in permanent use.

7. Regardless of conditions of provision of geological information expenses on its copying are refunded by the receiver of geological information separately.
