Regulations of State commission on counteraction to illicit trafficking in industrial output

I. General provisions

1. These Regulations establish procedure for activities of State commission for counteraction to illicit trafficking in industrial output (further - State commission).

2. Organizational and material logistics of activities of State commission is performed by the Ministry of Industry and Trade of the Russian Federation.

The Ministry of Industry and Trade of the Russian Federation gives organizational and methodical help to the representatives of federal executive bodies, other state bodies and organizations participating in preparation of materials for meeting of State commission controls terms of their preparation.

II. Powers of the chairman and members of State commission

3. Chairman of State commission:

a) performs management of activities of State commission;

b) conducts meetings of State commission;

c) signs protocols of meetings of State commission;

d) makes the decisions connected with activities of State commission;

e) represents State commission in the relations with federal bodies of the government, public authorities of subjects of the Russian Federation, and also with competent authorities of foreign states, the international and other organizations for the questions carried to competence of State commission;

e) represents to the Government of the Russian Federation no later than the second quarter of the year following for reporting, the report on situation in the sphere of illicit trafficking in industrial output in the territory of the Russian Federation.

4. In the absence of the chairman of State commission of power of the chairman of State commission one of vice-chairmen of State commission performs according to its decision.

5. Members of State commission have the equal rights by preparation and discussion of the questions considered at meeting.

6. Members of State commission have the right:

a) get acquainted with documents and materials of State commission;

b) speak at meetings of State commission, make offers on the questions entering competence of State commission;

c) vote at meetings of State commission;

d) involve in coordination with the chairman of State commission of specialists in the expert, analytical and other work connected with activities of State commission (further - experts);

e) state in writing special opinion in case of disagreement with the decision of State commission.

7. Members of State commission have no right to delegate the powers to other persons.

8. Members of State commission shall:

a) coordinate work on preparation of the questions submitted for consideration of State commission within the established field of activity of federal executive body which representative is the member of State commission;

b) be present at meetings of State commission;

c) organize accomplishment of decisions of State commission within the established field of activity of the member of State commission.

9. If fulfillment of duties on the State commission of position replaced by the member is assigned in accordance with the established procedure to other official, part in meeting of State commission is taken by this official (further - person fulfilling duties of the member of State commission).

10. If the member of State commission cannot personally participate in meeting of State commission, and fulfillment of duties on the State commission of position replaced by this member is not assigned in accordance with the established procedure to other official, the member of State commission not later than 3 calendar days about day of meeting shall inform in writing on it the chairman of State commission, and also provide to the Ministry of Industry and Trade of the Russian Federation the opinion concerning the agenda in writing.

11. The member of State commission and person fulfilling duties of the member of State commission have the equal rights in case of decision making.

III. Planning and organization of work of State commission

12. Meetings of State commission are held according to the plan of meetings of State commission (further - the plan) which is constituted for one calendar year.

13. The plan contains list of the main questions which are subject to consideration at meetings of State commission with indication of on each question of term of its consideration and persons responsible for preparation of question.

14. Meetings of State commission are held at least once in 3 months. In case of need according to the decision of the chairman of State commission unplanned meetings of State commission are held.

15. The notification on holding unplanned meeting of State commission and materials to it go to members of State commission not later than 15 calendar days about day of holding such meeting.

16. Offers on entering of questions into the draft of the plan go members of State commission in writing to the Ministry of Industry and Trade of the Russian Federation not later than 2 months prior to the beginning of the planned period or to the terms determined by the chairman of State commission and contain:

a) the name of question and short reasons for need of its consideration at meeting of State commission;

b) version of the proposed solution;

c) name of the body responsible for preparation of question;

d) list of collaborators;

e) consideration term at meeting of State commission.

17. If for entering into the draft of the plan the question which solution is not within the competence of the body offering it is proposed, the initiator provides carrying out preliminary coordination of the offer with state body which competence the question planned to consideration enters.

18. The draft of the plan prepared by the responsible secretary of State commission based on proposals of members of State commission is taken out for consideration at meeting of State commission and affirms the chairman of State commission taking into account results of discussion.
