1. Approve the enclosed Rules of creation and stock holding of pesticides for holding actions for quarantine of plants.

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan of its copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) publication of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of creation and stock holding of pesticides for holding actions for quarantine of plants

1. These rules of creation and stock holding of pesticides (further - Rules) are developed for holding actions for quarantine of plants according to the subitem 10) of Item 1 of article 7 of the Law of the Republic of Kazakhstan of February 11, 1999 "About quarantine of plants" and determine procedure for creation and stock holding of pesticides for holding actions for quarantine of plants.

2. The inventory of pesticides is intended for localization and liquidation of the revealed centers of distribution of quarantine objects and is created of amount of the pesticides which are purchased at the expense of budgetary funds.

3. The inventory of pesticides represents certain amount of regularly updated pesticides and is the state-owned property which is under authority (order) of Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (further - Committee).

4. The inventory of pesticides is created by Committee according to standard rates of inventory of pesticides for holding actions for quarantine of plants according to appendix to these rules.

5. The unused amount of pesticides of the current year in case of reduction of the projected area of processing passes into inventory of pesticides.

6. Storage of pesticides is performed in the conditions ensuring their safety according to requirements of the Law of the Republic of Kazakhstan of July 21, 2007 "About safety of chemical products".

7. Storage of pesticides is performed with observance of protective measures which include:

1) requirements to packaging and container for storage;

2) admissible lot of packaging of chemical products and term of its storage;

3) compatibility of products in case of storage with other types of chemical products;

4) general requirements to storage (temperature, pressure, humidity, illumination);

5) special measures to the chemical products capable to spontaneous ignition and spontaneous decomposition, including with formation of dangerous products;

6) measures for safe reuse of packaging, container and (or) their utilization;

7) measures for prevention of emergencies and liquidation of their effects;

8) individual protection equipment of personnel.

8. Storage of pesticides is performed in the packaging providing their consumer properties and protection against impact of their dangerous properties on health and human life, the environment.

9. The admissible regulation of mass of pesticides ensures safety of their impact or products of transformation during the storage duration determined by the plant of the producer (formulyanty).

10. In case of storage of the pesticides having capability to formation of the new connections increasing properties of danger of pesticides to provide the adequate protective measures excluding possibility of such transformation.

11. Reuse of container is possible only for identical substances. In case of the storage condition of pesticides to exclude possibility of its accidental mixing.
