1. This instruction is developed based on the free-trade agreements signed between the Republic of Moldova and stranamiuchastnitsa of the Pact of stability of Southeast Europe (Albania, Bosnia and Herzegovina, Bulgaria, Croatia, Macedonia, Serbia and Montenegro), the Law "About Chamber of Commerce and Industry" N 393-XIV of May 13, 1999, the Order of the Government of the Republic of Moldova N 1599 of December 13, 2002, other provisions of the current legislation.
2. The Chamber of Commerce and Industry carries out expertizes by determination of the country of goods' origin based on the free-trade agreements signed between the Government of the Republic of Moldova and member countries of the Pact of stability of Southeast Europe, "The instruction about procedure for conducting examination of goods by experts of Chamber of Commerce and Industry of the Republic of Moldova" of 25.12.2003. (The official monitor of the Republic of Moldova, N 35-38 of 27.02.2004), other provisions of the current legislation.
3. Examination purpose:
- determine based on the documents (with indication of production process or technological transactions) provided by exporters, quantities of the components and materials used in production of the goods intended for export;
- determine country of source of the used components;
- determine the cost of each component;
- determine share of the imported components used in case of production of the exported products, in the ratio with the factory price of end products.
4. List of the additional documents necessary for creation of the report on examination:
a) the documents confirming origin of raw materials, semifinished products, materials, components (delivery agreements, accounts, payment orders, road and transport delivery notes, customs declarations, etc.);
b) the documents confirming the right to acquisition and conversion of raw materials (for the buying and preparing organizations);
c) the veterinary certificate in case live animals, live stock products, the raw skins, wool and other raw materials of animal origin are exported;
d) documents according to which the goods production process is performed (process charts);
e) other documents necessary for examination.
5. Within conducting examination the representative of Chamber of Commerce and Industry has the right:
visit the company;
study production;
analyze and check technological transactions on production of the exported goods;
request any supporting document and perform any check which considers reasonable, etc.
6. The report on examination is issued within 5 working days from the date of submission of the documents necessary for determination of origin.
7. In the report of examination all types of products in the corresponding batch, duration of production cycle and consumption of raw materials for production of end products are specified.
8. If as a result of examination it is determined that the exported goods correspond to the criteria of origin established by free-trade agreements the transport certificate of EUR 1 - the document confirming goods origin in member countries of the Pact of stability of Southeast Europe is issued.
9. If as a result of examination it is determined that the exported goods do not correspond to the established criteria of origin, the certificate of not preferential origin is issued.
10. The report on examination is stored in archive of Chamber of Commerce and Industry of the Republic of Moldova within three years.
11. Responsibility for reliability of the documents submitted to chamber and data specified in them is born by the applicant.
12. Experts of Chamber of Commerce and Industry bear according to the current legislation responsibility for intentional introduction of wrong data in reports on examination.
13. Chamber of Commerce and Industry shall provide confidentiality of the provided information according to the current legislation.
