About approval of regulations of the state services in the sphere of judicial and expert activities

According to the subitem 2) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve:

1) regulations of the state service "Certification of Court Experts" according to appendix 1 to this order;

2) regulations of the state service "Assignment of Qualification of the Court Expert" according to appendix 2 to this order;

3) regulations of the state service "Certification of Medicolegal, Forensic-psychiatric, Judicial and Narcological Experts" according to appendix 3 to this order;

4) regulations of the state service "Assignment of Qualification on the Right of Production of Certain Type of Medicolegal, Forensic-psychiatric and Judicial and Narcological Examinations" according to appendix 4 to this order.

2. To provide to the center of judicial examination of the Ministry of Justice of the Republic of Kazakhstan:

1) state registration of this order;

2) official publication of this order in periodic printing editions and in information system of law of Ad_let within ten calendar days after its state registration;

3) placement on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising Deputy minister of justice of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of the state service "Certification of Court Experts"

1. General provisions

1. The state service "Certification of Court Experts" (further - the state service) appears the Ministry of Justice of the Republic of Kazakhstan (further - the service provider) by means of office of the service provider - the Center of judicial examination (further - the Center) or through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal).

2. Form of rendering the state service: electronic (partially automated), paper.

Rendering the state service issue of the conclusion of certifying commission of the service provider in form, according to appendix 1 to the standard of the state service "Certification of Court Experts", the Minister of Justice of the Republic of Kazakhstan approved by the order of May 14, 2015 is result No. 270 "About approval of standards of the state services in the field of judicial and expert activities" (it is registered in the Register of state registration of regulatory legal acts for No. 11339).

the employee of office of the Center performs documents acceptance and registration on the portal, the receipt (notification) on documents acceptance - time of execution of 15 (fifteen) minutes is issued to uslugopoluchatel;

the head determines the contractor - completion date 4 (four) hours;

the official responsible for rendering the state service (further - the official), checks completeness and compliance of the submitted documents. In case of discrepancy of completeness of the submitted documents, to qualification requirements to uslugopoluchatel the motivated refusal - goes 4 (four) working days;

the official prepares materials of uslugopoluchatel for consideration by certifying commission when holding interview, participates in quality of the secretary of certifying commission when holding interview, takes the minutes of certifying commission - completion date of 11 (eleven) working days;

the uslugopoluchatel comes in due time and the place for certification passing;

the certifying commission holds testing - time of execution of 90 (ninety) minutes.

In case of positive result of testing the uslugopoluchatel is allowed to interview;
