1. Approve the enclosed Rules of transportation, acceptance, accounting, assessment, storage and realization of precious metals, gemstones and products from them turned (arrived) into property of the state on the separate bases.

2. To committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan (Utepov E. K.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of transportation, acceptance, accounting, assessment, storage and realization of precious metals, gemstones and products from them turned (arrived) into property of the state on the separate bases

Chapter 1. General provisions

1. Rules of transportation, acceptance, accounting, assessment, storage and realization of precious metals, gemstones and products from them turned (arrived) into property of the state on the separate bases (further – Rules), are developed according to item 4 of article 215 of the Law of the Republic of Kazakhstan "About state-owned property" (further – the Law) and establish procedure for transportation, acceptance, accounting, assessment, storage and realization of precious metals, gemstones and products from them turned (arrived) into property of the state on the separate bases.

2. The basic concepts and reducings used in Rules:

1) the initial price - the price established by the commission based on the valuation report of the appraiser;

2) service of special communication - republican service of special communication of the National operator of mail;

3) gemstones - natural diamonds, emeralds, rubies, sapphires and alexandrite, and also natural pearls in the crude (natural) and processed type and unique amber educations;

4) precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium and osmium);

5) jewelry and other products from precious metals and gemstones (further - products) - products, except for coins from precious metals, made of gemstones, precious metals and their alloys with use of different types of art processing, with inserts from gemstones and other materials of natural or artificial origin or without them, applied as various jewelry, utilitarian household items and (or) to the cult and decorative purposes;

6) the scrap and waste of precious metals which - became useless, which lost operational value or subject to liquidation of product and (or) their components which contain precious metal, and also the remaining balance of the materials containing precious metal, intermediate products of metallurgical production which is formed in case of production and use of products of technical and household purpose including unrecoverable scrap which can be used for the subsequent conversion for the purpose of extraction of precious metals;

7) local executive bodies - local executive bodies of areas, cities of regional value;

8) jewelry inserts - the natural, synthetic stones and stones imitations which are put in order in jewelry, and also the non-noble metals inserted into jewelry used in jewelry production;

9) jewelry stones - precious and the jewelry ornamental stones used in jewelry production;

10) the commission - the commission created by the decision of authorized body or local executive body according to the order of the Government of the Republic of Kazakhstan of July 26, 2002 No. 833 "Some questions of accounting, storage, assessment and further use of the property turned (arrived) in property state on the separate bases" (further - Rules No. 833);

11) values - precious metals, gemstones and products from them;

12) the body (person) which withdrew (transferring values - the bodies of state revenues, persons giving values on the bases, the stipulated in Article 210 Laws;

13) sending with values - sent by the sender to the Center of cash transactions and storage of values (branch) of republican public institution "National Bank of the Republic of Kazakhstan" (further - the Center) the values packed, which are sealed up (sealed) according to requirements stipulated in Item 4 these rules, and accompanying documents to them;

14) the place with values - one or several investments packed into one container (sack, box, box and another) with the inventory (for scrap and waste of precious metals is not constituted) which is sealed up by the commission of the Center and supplied with label with indication of the name of values (account), quantity (products), general, ligaturny and chemically net weight (in case of possibility of their calculation), the mass of discount (in the presence), tests (content of precious metal), numbers and dates of the act, surname, name and middle name of the expert and the controller;

15) final acceptance and sorting of values - determination of quantity, weight (general, ligaturny and chemically net (in case of possibility of their calculation), tests of values (mass fraction of precious metal in alloy), classification and determination of mass of jewelry inserts (in the presence), their reconciliation with data of accompanying documents of the sender (with the inventory or the act of the inventory) with sorting of values according to the established types of values and tests of precious metals;

16) the commission of the Center - the commission consisting of the expert and the controller for implementation of opening of sending with values, acceptance and sorting of the values which are in them;

17) investment - one or the group of uniform objects (products), one type of precious metals, identical test or content of precious metals placed in one primary package (paper or polyethylene bag, paper) with indication of the name, quantities (products), general and ligaturny weight, mass of discount (in the presence) and tests (content of precious metal);

18) seller - Committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) and its territorial subdivisions or local executive body;

19) the buyer - the physical or non-state legal entity acquiring values in implementation process;

20) trade organizations - the individual entrepreneur or the non-state legal entity or their associations enabling the storage and the realization of values involved according to the procedure, determined by the legislation of the Republic of Kazakhstan on public procurements, for making of one or several transactions for remuneration;

21) synthetic stones - the artificial crystal products on physical and chemical properties corresponding to these or those natural stones;

22) stones imitations - counterfeits of natural or synthetic stones, and also the products in parts or in full made the person. These stones imitate effect, color and appearance of natural jewelry or synthetic stones, without transferring their chemical and/or physical properties and/or their crystal structure;

23) the web portal of the register (further - the register) - the Internet resource placed on the Internet to the address: www.gosreestr.kz, and providing single point of access to the electronic database on accounting and realization of Property;

24) authorized body - Committee and its territorial subdivisions.

Chapter 2. Procedure for transportation, acceptance and storage of values

3. Legal executives or bodies (persons) who withdrew (transferring) values in writing inform authorized body or local executive body on date, the place and time of transfer of values in time, at least in five working days prior to their making, with application of copies of the documents specified in Item 8 of Rules No. 833.

Transfer of values from legal executives or bodies (persons) who withdrew (transferring) to value, to authorized body or local executive body is performed in established date, time and the place, under the act of the inventory, assessment and (or) reception-transmission of property (further - the delivery-acceptance certificate) with indication of the name of property with the detailed characteristic of each subject, unit of measure, quantity, provisional estimate in case of acceptance of property for unit, the amounts.

The delivery-acceptance certificate is drawn up by authorized body or local executive body in form according to appendix 1 to Rules No. 833, in quantity on number of the parties specified in it.

The values turned (arrived) into municipal property on the bases ownerless, heritable, treasure, not containing things relating to cultural values, finds are transferred by local executive bodies to territorial subdivisions of Committee for their further transfer to territorial branch of National Bank of the Republic of Kazakhstan (further - territorial branch of National Bank) or the Center in time, no more than ten calendar days from the date of acceptance to accounting.

3-1. The organization of work on storage of the values turned (arrived) into municipal property before transfer to territorial subdivisions of Committee is made by local executive bodies.

The organization of work on storage of values before transfer (direction) to the Center or territorial branch of National Bank is made by territorial subdivisions of Committee.

The choice of the service provider on storage of values is performed by territorial subdivisions of Committee (local executive bodies) according to the legislation of the Republic of Kazakhstan on public procurements among the legal entities performing activities based on the license for carrying out banking and other activities issued by authorized body on regulation, control and supervision of the financial market and the financial organizations.
