1. Approve the enclosed Rules of determination and review of classes of energy efficiency of buildings, structures, constructions.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of determination and review of classes of energy efficiency of buildings, structures, constructions

1. General provisions

1. These rules of determination and review of classes of energy efficiency of buildings, structures, constructions (further - Rules) are developed according to subitem 6-9) of Article 5 and Item 5 of article 11 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increase in energy efficiency" and determine procedure for determination and review of classes of energy efficiency of buildings, structures, constructions.

2. The class of energy efficiency of the building, structure, construction is determined:

1) in case of accomplishment of project (project and estimate) documentation of construction new or expansions (capital repairs, reconstruction) of the existing buildings, structures, constructions with amount of consumption of energy resources, equivalent five hundred and more tons of conditional fuel in one calendar year;

2) in case of accomplishment of project (project and estimate) documentation of construction new or expansions (capital repairs, reconstruction) of the existing buildings, structures, constructions with amount of consumption of energy resources less than five hundred tons of conditional fuel in one calendar year at the initiative of the customer of project (project and estimate) documentation.

Information on class of energy efficiency of new buildings, structures and constructions or the existing buildings, structures and constructions which underwent expansion (reconstruction, capital repairs) is accepted according to technical data sheet of the object constructed and put into operation or the acceptance act of object in operation and is valid within five years from the moment of their commissioning.

3. The class of energy efficiency of the existing buildings, structures and constructions is determined following the results of the carried-out energy audit and is valid within five years from the moment of carrying out energy audit.

2. Procedure for determination and review of classes of energy efficiency of buildings, structures, constructions

The owner of the existing building, structures, constructions for determination of their classes of energy efficiency addresses the legal entity who received the certificate on accreditation on this type of activity for carrying out energy audit according to the order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of the industry and new technologies of the Republic of Kazakhstan of October 3, 2012 No. 354 (registered in the Register of state registration of regulatory legal acts No. 8073).

By results of energy audit the conclusion containing information on class of energy efficiency of buildings, structures, constructions is issued.

5. For determination of class of energy efficiency in case of development of project (project and estimate) documentation of construction new or expansions (capital repairs, reconstruction) of the existing buildings, structures, constructions:

1) the customer specifies required class of energy efficiency in task for development of project (project and estimate) documentation;

2) project (project and estimate) documentation is developed taking into account the energy efficiency class specified in task for development;

3) the class of energy efficiency of the object established in the project documentation is specified in the conclusion of the complex non-departmental examination of construction projects performed according to the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan".

6. The class of energy efficiency is reviewed by carrying out energy audit at least once each five years.

7. The class of energy efficiency is determined according to the indicators specified in appendix to these rules according to the state standard rates, construction regulations and rules of architectural, town-planning and construction activities of the Republic of Kazakhstan, and of energy saving and increase in energy efficiency.

8. The class of energy efficiency is specified in technical data sheet of the building, structure, construction.
