About waste
This Law governs the relations in the field of the address with waste, is directed to reducing formation of waste and ensuring their rational use in economic and other activity for the purpose of prevention of their negative impact on health of the population and the environment.
In this Law the following basic concepts are used:
1) waste - substances (raw materials types), not suitable for production of certain products, which are subject to further utilization or placement from which useful properties are taken;
2) the address with waste - the activities connected with prevention of formation of waste, their collection, transportation, storage, processing, utilization, neutralization and burial;
3) production wastes - remaining balance of raw materials, materials, semifinished products, other products or products which were formed in production process, and also the goods (products) which lost the consumer properties, technogenic mineral educations and waste of agricultural production;
4) type of waste - waste which have general signs according to classification system of waste on danger class;
5) household waste - the waste which is formed in the course of life activity of the person;
6) dangerous wastes - waste which existence and (or) the address of which pose hazard to life, health of the person and the surrounding environment;
7) the producer of waste - legal entity or physical person which productive or economic activity leads to formation of waste;
8) collection of waste - the activities connected with accumulating, sorting, neutralization, utilization and placement of waste in specially allotted places or on specially equipped objects;
9) transportation of waste - transportation of waste from places of their education or storage to places or objects of conversion, utilization or burial;
10) cross-border transportation of waste - transportation of waste from the territory and (or) through the territory of Turkmenistan on the territory or through the territory of other state;
11) placement of waste - storage and (or) waste disposal on the objects which are specially equipped for this purpose;
12) storage of waste - temporary content of waste in places of their education until their subsequent use, neutralization or burial;
13) waste disposal - long-term isolation of the waste which is not subject to further use on the objects which are specially equipped for this purpose for the purpose of prevention of hit of hazardous substances to the environment;
14) subject to placement of waste - the specially allotted and equipped place for placement of waste (polygons for production and household waste, shlamokhranilishcha, dumps of rocks, fields of evaporation of sewage);
15) conversion of waste - implementation of the technological transactions connected with change of physical, chemical or biological properties of waste for the purpose of use of waste or preparation them to ecologically safe storage, transportation, utilization or burial;
16) use of waste - application of waste for production or receipt of energy;
17) waste recycling - extraction from waste of valuable components or use of waste as secondary raw materials, fuel, fertilizers and for other purposes;
18) neutralization of waste - reduction or elimination of negative impact of waste on health of the population and the environment by mechanical, physical and chemical or biological processing;
19) limit of placement of waste - the maximum permissible number of waste of specific type which are allowed to be placed by certain method for fixed term on subjects to placement of waste taking into account ecological situation in this territory;
