About approval of some regulations on enforcement of provisions of the Code of rail transport

(as amended of the Order of the Government of the Republic of Moldova of 20.07.2018 No. 738)

Based on part (1) Articles 21, parts (1) Article 28 and Item b) article 165 of the Code of N 309-XV rail transport of July 17, 2003. (The official monitor of the Republic of Moldova, 2003, N 226-228, Art. 892) DECIDES: the Government

1. Approve:

Regulations on discipline of workers of rail transport according to the appendix N 1.

Regulations on rendering services in public conveyance, baggage, load and cargo baggage for personal needs on rail transport according to the appendix N 2.

2. Declare invalid the Order of the Government N 884 of September 30, 1999. "About approval of Provisional regulations for discipline of workers of rail transport" (The official monitor of the Republic of Moldova, 1999, N 109-111, Art. 950).

3. To impose control over the implementation of this resolution on the Ministry of Economy and Infrastructure.

Regulations on discipline of workers of rail transport

I. General provisions

1. The regulations on discipline of workers of rail transport (further - provision) are developed on the basis of the Labor code N 154-XV of March 28, 2003, and also part (1) Article 21 and Item b) article 165 of the Code of N 309-XV rail transport of July 17, 2003 and determine special conditions of respect for discipline of work by workers of rail transport.

2. Action of this provision extends to all employees of the companies of rail transport, irrespective of form of business, including to workers of the device of railway administration. The exception is constituted by workers of industry whose activities are not connected directly with transportation process (employees of the construction organizations, medical and sanitary, cultural, sanatorium and improving organizations).

3. The discipline of work on rail transport is provided by creation of favorable economic, social, legal and organizational conditions by the employer for high-productive work, education at workers of conscientious attitude to work, application of measures of encouragement for honest work, and also disciplinary measures for misconduct.

The discipline of workers of rail transport consists in strict observance of the procedure, rules and regulations established by the current legislation, regulations applied on rail transport in accomplishment of orders and instructions of heads of the central industry body of public management, the companies of rail transport by them (further - heads), and also performed by the obligations provided by employment contracts.

4. Persons appointed to the positions which are directly connected with train movements shall be prepared from the professional point of view, and their state of health shall allow them to carry out the service duties. The list of these positions affirms the railway administration exercising direct operation of train movements. Specified persons, and also the workers employed with heavy and harmful working conditions are subject to obligatory medical examination and periodic surveys.

5. Termination of work as cure of collective employment disputes, on rail transport is forbidden as it is gross violation of labor discipline and involves responsibility according to the current legislation.
