About questions of introduction of single system of state registration of real estate and the rights to it

According to article 68 of the Law of the Republic of Tajikistan "About state registration of real estate and the rights to it", articles 42 and 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Transition period prior to implementation of organization activity on state registration of real estate and the rights to it in the territory of the Republic of Tajikistan to establish since July 1, 2015 lasting 6 months.

2. Establish during transition period the pilot cities and areas the following administrative and territorial units of the Republic of Tajikistan:

- city of Khorog of the Gorno-Badakhshan Autonomous Region;

- city of Khujand of Sughd area;

- city of Istaravshan of Sughd area;

- city of Kulob of Khatlon Region;

- Bokhtarsky district of Khatlon Region;

- Gissar district;

- Rasht district.

3. State committee on land management and geodesy of the Republic of Tajikistan:

- prior to organization activity on state registration in the pilot cities and areas within the competence to develop and approve regulatory legal acts on state registration of real estate and the rights to it and in accordance with the established procedure to make their state registration;

- in case of need to provide offers to the Government of the Republic of Tajikistan on completion of regulatory legal acts of the Republic of Tajikistan.

4. To the state unitary enterprise "Registration of Real Estate":

- develop and approve the actions plan on implementation of single system of state registration of real estate and the rights to it in the pilot cities and areas and to provide its accomplishment;

- prior to implementation of state registration in the pilot cities and areas to provide the state affiliated enterprises "Registration of Real Estate" with documents of the single state register of real estate;

- exercise control of correctness of making of state registration of real estate;

- perform holding information actions for explanation of the Law of the Republic of Tajikistan "About state registration of real estate and the rights to it".

5. To render the Ministries of the Interior and Justice of the Republic of Tajikistan, executive bodies of the government of the Gorno-Badakhshan Autonomous Region, areas, areas of republican subordination all assistance in introduction of single system of state registration of real estate in the pilot cities and areas.

6. No. 225, after the paragraph of the thirty sixth to add item 4 of the Provision of the State committee on land management and geodesy of the Republic of Tajikistan approved of May 3, 2010 with new paragraphs of the following content:

"-approval of procedure for provision, replacement and recognition voided the Certificate on rights to use by the earth, the Certificate on state registration and the Certificate on land share;

- approval of form of the lease agreement on the parcel of land.".

7. Since January 1, 2016 to enter single system of state registration of real estate and the rights to it in all cities and the regions of the Republic of Tajikistan.

8. Since January 1, 2016 to recognize invalid:

- the order of the Government of the Republic of Tajikistan of July 22, 1998, No. 244 "About measures for accomplishment of the Presidential decree of the Republic of Tajikistan "About realization of right to use by the earth";

- the order of the Government of the Republic of Tajikistan of July 2, 2009, No. 374 "About approval of the Rule of procedure for registration, issue, registration, replacement and about recognition voided the Certificate on right to use by the earth and the Certificate on land share";

- Item 3 of the order of the Government of the Republic of Tajikistan of February 27, 2010, No. 105 "About modification of some orders of the Government of the Republic of Tajikistan";

- the order of the Government of the Republic of Tajikistan of July 1, 2011, No. 341 "About modification and amendments in the order of the Government of the Republic of Tajikistan of July 2, 2009, No. 374".
