About approval of Rules of involvement of independent experts when conducting external examination

According to subitem 102-1) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" PRIKAZYVAYU:

1. Approve the enclosed Rules of involvement of independent experts when conducting external examination.

2. To provide to committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Tsoi A. V.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of involvement of independent experts when conducting external examination

Chapter 1. General provisions

1. These rules of involvement of independent experts when conducting external examination are developed according to subitem 102-1) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code) and determine procedure for involvement of independent experts when conducting external examination.

2. The purpose of involvement of independent experts is:

1) providing the rights of patients to receipt of medical care of necessary amount and proper quality on the basis of optimum use of personnel, material resources of subjects of health care and use of modern medical technologies;

2) ensuring transparency and objectivity of assessment of activities of subjects of health care, competence of health workers, qualification level of specialists;

3) ensuring relevance and justification of recommendations when forming general requirements to delivery of health care to the patient in case of certain disease or clinical situation.

3. The basic concepts applied in these rules:

1) the subject of health care - the organization of health care, except for the organizations performing activities in the sphere of sanitary and epidemiologic wellbeing of the population and also the physical persons practising private medicine and pharmaceutical activities;

2) physical person - citizens of the Republic of Kazakhstan, citizens of other states, and also stateless persons;

3) the legal entity - the organization which has on the property right of economic maintaining or operational management the isolated property also answers this property for the obligations, can acquire and perform on its own behalf the property and personal non-property rights and obligations, to be claimant and the defendant in court;

4) examination of quality of medical services (further - Examination) - set of the organizational, analytical and practical actions performed for pronouncement of the conclusion on the quality level of the medical services provided by physical persons and legal entities with use of the indicators reflecting performance indicator, completeness and compliance of medical services to standards. Examination is subdivided on internal and external;

5) independent examination - the procedure which is carried out by independent experts within external examination for the purpose of pronouncement of the conclusion about the quality level of the rendered medical services provided by subjects of health care with use of the indicators reflecting performance indicator, completeness and compliance of the rendered medical services to standards;

6) the independent expert - the physical person having the higher medical education and conforming to requirements to the physical persons applying for conducting independent examination, certain authorized body.

4. Physical persons and subjects of health care receive the information about independent experts from databank of accredited independent experts in the field of health care.

5. The independent expert is attracted when conducting external examination taking into account its medical and pharmaceutical specialty.

6. Fee on conducting independent examination is performed on the basis of the act of the performed works.

Chapter 2. Procedure for involvement of independent experts when conducting external examination

7. Independent experts are attracted when conducting external examination of activities of subjects of health care:

1) authorized body and its territorial subdivisions;

2) subjects of health care;

3) physical persons or legal entities.

8. Independent experts when conducting external examination are attracted:

1) authorized body and its territorial subdivisions in case of commission analysis in cases:

conducting checks in the sphere of quality of rendering medical services regarding compliance of activities of the checked subjects to the requirements established by the legislation of the Republic of Kazakhstan;

carrying out accreditation of subjects of health care according to the order of the Minister of health and social development of the Republic of Kazakhstan of March 10, 2015 No. 127 "About approval of Rules of accreditation of health care" (registered in the Register of state registration of regulatory legal acts for No. 10735);

examinations of the treated cases with lethal outcomes;

2) subjects of health care on contractual basis;

3) physical persons or legal entities in disagreement cases with conclusions of external examination.
