According to subitem 8-1) of article 37-1 of the Water Code of the Republic of Kazakhstan of July 9, 2003, I ORDER:

1. Approve the enclosed Rules of subsidizing of cost of services in supply of drinking water from especially important group and local water supply systems which are uncontested sources of drinking water supply.

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing of cost of services in supply of drinking water and from especially important group and local water supply systems which are uncontested sources of drinking water supply

Chapter 1. General provisions

1. These rules of subsidizing of cost of services in supply of drinking water, from especially important group and local water supply systems which are uncontested sources of drinking water supply (further - Rules) are developed according to subitem 8-1) of article 37-1 of the Water code of the Republic of Kazakhstan (further - the Water code) and determine procedure for subsidizing of cost of services in supply of drinking water, from especially important group and local water supply systems which are uncontested sources of drinking water supply by the lists approved respectively by authorized body in the field of use and protection of water fund, water supply, water disposal or local executive bodies of areas (further - water supply systems), according to subitem 7-9) of Item 1 of Article 37 and the subitem 1) of part two of article 39 of the Water code, for the account and within means, stipulated by the legislation about the republican budget or decisions of maslikhats on local budgets for the corresponding financial year, budget subventions, transferred from the republican budget to subordinate budgets within the amounts approved in the republican budget (further - subsidies).

2. In these rules the following concepts are used:

1) the administrator - the structural division of local executive body of area determined by the akim of area supervising the sphere of the housing-and-municipal relations;

2) receivers of budgetary funds - the physical persons and legal entities receiving budgetary funds through the administrator of budget programs and using them within implementation of budget programs;

3) local water supply systems - the systems pumping drinking water to consumers of one settlement;

4) authorized body in the field of municipal services - the central executive body performing management and cross-industry coordination in the field of water supply and water disposal within settlements;

5) the request - the address of the subject of natural monopoly provided to the administrator on the need for subsidizing.

6) authorized body in the field of use and protection of water fund, water supply, water disposal - the state body performing management function and control in the field of use and protection of water fund, water supply, water disposal outside settlements;

7) the water user - physical person or legal entity which according to the procedure, established by the legislation of the Republic of Kazakhstan, is granted right to use of water resources for satisfaction of own needs and (or commercial interests);

8) the organization for water supply and (or) water disposal - the water management organization performing operation of water supply systems and water disposal in settlements;

9) the subject of natural monopoly - the individual entrepreneur or the legal entity providing to consumers regulated services;

10) authorized body in the field of natural monopolies - the state body performing management in the respective spheres of natural monopolies;

11) group water supply systems - the water supply systems pumping drinking water to consumers of several settlements;

3. Subsidies intend to the organizations for water supply and (or) water disposal servicing water supply systems for reduction in cost of cost of the services in supply of drinking water realized to the population on satisfaction of own needs on drinking water.

4. The size of the allocated subsidies for 1 (one) cubic meter of the pumped drinking water from water supply systems for the organization for water supply and (or) water disposal is determined:

as difference between the rate for water supply services approved by territorial department of authorized body in the field of natural monopolies and the amount of payment the population for 1 (one) cubic meter of the pumped drinking water from water supply systems according to the approved Method of calculation of the amount of payment for one cubic meter of the pumped drinking water to the population from especially important group and local water supply systems which are uncontested sources of drinking water supply according to subitem 8-9) of article 37-1 of the Water code;

0 (zero) tenge for 1 (one) cubic meter of the pumped water requiring further cleaning and finishing it to condition of drinking water consumption.
