About the Procedure of office supervision in system of executive bodies of the government of the Republic of Tajikistan

1. Approve the Procedure of office supervision in system of executive bodies of the government of the Republic of Tajikistan it (is applied).

2. To provide to heads of the central executive bodies of the government execution of requirements of this Procedure.

Procedure of office supervision in system of executive bodies of the government of the Republic of Tajikistan

1. General provisions

1. The procedure of office supervision in system of executive bodies of the government of the Republic of Tajikistan (further - the Procedure) is developed according to article 7 of the Law of the Republic of Tajikistan "About system of state bodies of the Republic of Tajikistan" and regulates procedures of office supervision in executive bodies of the government of the Republic of Tajikistan.

2. Office supervision in executive bodies of the government of the Republic of Tajikistan (further - office supervision) is complex of committed measures providing legality, efficiency and feasibility in activities of executive bodies of the government by means of which the higher executive body of the government performs functions of supervision concerning subordinate executive body of the government.

3. Office supervision is watch system, checks of activities of subordinate executive bodies of the government, subordinated divisions and their officials, and also component of public administration and one of the main functions of implementation of managerial powers.

4. The state bodies exercising office supervision are heads of the central higher executive bodies of the government according to the legislation of the Republic of Tajikistan providing independently or by means of authorized structural divisions in subordinate executive bodies of the government, control of execution of the regulatory legal acts and effective activities provided in the Scheme of management of structures, organizations and organizations of system of the central executive bodies of the government (further - subordinate bodies and subordinated divisions).

5. This Procedure does not extend concerning local executive bodies of the government and self-government institutions of settlements and villages.

6. The state bodies exercising office supervision do not make the checks which are within the competence of bodies of prosecutor's office, law enforcement, military and customs authorities, bodies of the state financial control, tax authorities, protection of the state secrets and also in spheres, stipulated by the legislation other procedure. In necessary cases or on representation of the specified bodies, the state bodies exercising office supervision can render assistance in this direction.

7. Heads of the state bodies exercising office supervision in subordinate bodies and subordinated divisions realize planning and the organization of work of state body according to the legislation and bear responsibility for its effectiveness.

8. The purposes, tasks and procedures of office supervision provided by this Procedure first of all are directed to forming of mutual cooperation of subordinate bodies and subordinated divisions, with higher state bodies, in turn higher state bodies with Executive office of the President of the Republic of Tajikistan, and in general promote improvement of quality and efficiency of activities of state bodies,

9. Office supervision is based on the following principles:

- legality (rule of the Constitution and laws of the Republic of Tajikistan);

- accurate accountability;

- equality of all before the law;

- transparency and publicity of office supervision, except for stipulated by the legislation restrictions;

- respect for public (public) concerns;

- planning and system supervision;

- respect for ethics;

3. Purposes of office supervision

10. The purposes of office supervision are:

- receipt of reliable and authentic information about condition of realization of legality, discipline, efficiency of activities, the timely notice of heads on the current situation, identification of shortcomings and accountability of ranking officers for non-execution of service duties according to the legislation of the Republic of Tajikistan;

- protection and effective use of manpower;

- property, capacity of subordinate bodies and subordinated divisions;

- timely tallying of activities of subordinate bodies and subordinated divisions, to the internal and external changes connected with social and economic development;

- ensuring effective activities of subordinate bodies and subordinated divisions, and also their stability and development;

- high-quality ensuring execution of regulatory legal acts, the documents promoting successful management and acceptance of effective management decisions;

- careful and rational use of the available resources;

- observance of regulations, service duties, job descriptions, office ethics, accomplishment of working plans, orders of management;

- comparison of reality of provision of work with the established tasks and functions.

4. Main objectives of office supervision

11. The main objectives of office supervision are:

- implementation of constant control of activities of subordinate bodies and subordinated divisions;

- the organization and conducting check of activities according to the plan and provisions;

- taking measures, the requirements of regulatory legal acts and other regulations of the respective sphere established by the legislation of the Republic of Tajikistan on observance, elimination of the revealed shortcomings;

- ensuring economic, food security, protection of state-owned property, environment.

12. The state bodies exercising office supervision according to the main objectives, stipulated in Item 11:

- realize state policy in the sphere of office supervision in the corresponding industry;

- will organize and realize office supervision according to the laws of the Republic of Tajikistan and other regulatory legal acts of the respective sphere;
