About approval of Rules of hunting

According to the subitem 57) Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna" PRIKAZYVAYU:

1. Approve the enclosed Rules of hunting.

2. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of hunting

Chapter 1. General provisions

1. These rules of hunting (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna" (further - the Law) and determine procedure and terms of carrying out hunting for the territories of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) amateur (sports) hunting - getting of the animal species which are subject to hunting for the purpose of satisfaction of sports, esthetic requirements and for private consumption of the got products;

2) trade hunting - getting of the animal species which are subject to hunting for the purpose of business activity;

3) national hunting - getting of the animal species which are subject to amateur (sports) hunting with use of hunting predatory birds and national breeds of hunting dogs.

3. Hunting is subdivided into the following types:

1) trade hunting;

2) amateur (sports) hunting, including national hunting.

4. According to article 33 of the Law physical persons have the right to hunting under condition:

1) achievements of twenty-one-year age if hunting is conducted using firearms;

2) achievements of fourteen-year age if hunting is conducted using other types of tools of getting permitted by these rules, hunting dogs and hunting predatory birds;

3) availability of the certificate of the hunter in the form approved by the order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of February 2, 2018 No. 60 "About approval of form and Rules of certification of the hunter, fisherman and huntsman" (it is registered in the Register of the state registration of regulatory legal acts at No. 16463) (further – the certificate of the hunter);

4) receipts of permission to use of fauna in the form provided in appendix 1 to Rules of issue of permission to use of the fauna approved by the order of the acting minister of agricultural industry of the Republic of Kazakhstan of December 19, 2014 No. 18-04/675 (it is registered in the Register of the state registration of regulatory legal acts at No. 10168) (further - permission to use of fauna) or permits of the subject of hunting in the form provided in appendix 1 to the order of the acting minister of agricultural industry of the Republic of Kazakhstan of February 27, 2015 No. 18-03/145 "About approval of standard form of the permit, and also Rules of its issue" (it is registered in the Register of the state registration of regulatory legal acts at No. 10702) (further – the permit of the subject of hunting).

The right to hunting for foreigners in the territory of the Republic of Kazakhstan arises based on the contract for the organization of hunting with the subject of hunting, receipt of permission to use of fauna, the permit, and also the conclusion of law-enforcement bodies on import to the territory of the Republic of Kazakhstan and export from the Republic of Kazakhstan of fire hunting weapon and cartridges to it.

5. In case of withdrawal of objects of fauna for the purpose of production of hunting trophies are filled in the protocol of hunting in form according to appendix 1 to these rules and trophy sheets on animal species in forms according to appendices 2 - 9 to these rules,

Chapter 2. Procedure for carrying out hunting

7. Trade hunting is performed in the presence at the hunter of the following documents:

1) certificates of the hunter;

2) permissions to use of fauna or permits of the subject of hunting;

3) when hunting using hunting firearms - permission to storage, storage and carrying civil weapon and cartridges to it to physical persons;
