Regulations on check points through frontier of the Kyrgyz Republic

I. General provisions

1.1. The regulations on check points through frontier of the Kyrgyz Republic (further - the Provision) regulate procedure for opening, functioning and closing of check points through frontier of the Kyrgyz Republic (further - check points).

This Provision is developed based on the Law of the Kyrgyz Republic "About frontier of the Kyrgyz Republic" and other regulatory legal acts of the Kyrgyz Republic.

1.2. Check points are intended for providing the international messages of the Kyrgyz Republic with other states.

1.3. Check points - the territory within the railway, automobile station, the station, the airport, airfield open for the international messages, and also on specially equipped places where are performed boundary, customs, sanitary and quarantine, veterinary, phytosanitary and other types of control according to the legislation of the Kyrgyz Republic of persons crossing frontier, goods, vehicles and other property.

1.4. The check point within the territory of the specified objects includes complex of buildings, rooms, constructions with the corresponding processing equipment in which bodies boundary, customs and other types of control, and also the transport and other enterprises and the organizations ensuring functioning of the check point perform office activities.

On each check point through frontier of the Kyrgyz Republic the passport of the check point according to appendix to this Provision is constituted.

1.5. For ensuring control of observance by persons of statutory rules of crossing of frontier of the Kyrgyz Republic, movement through it of goods, vehicles and other property with relevant organs of the executive authority at check points divisions of bodies of border, customs, sanitary and quarantine, immigration, veterinary, phytosanitary and transport control, control of drug trafficking, psychotropic substances and precursors, and for control of observance by carriers of requirements of international agreements and conventions in the field of air, automobile and railway service, prevention of acts of illegal intervention in activities of civil aviation - bodies of the state motor transportation control, aviation safety and traffic safety of trains are created (further - the state regulatory authorities).

1.6. According to regulatory legal acts of the Kyrgyz Republic, behind crossing of frontier by persons, vehicles, freights and other property implementation of the following types of control is assigned:

- border and migratory control - on authorized state body on protection of frontier;

- customs control - on authorized state body in the sphere of customs affairs;

- sanitary and quarantine control - on authorized state body in health sector;

- veterinary and phytosanitary control - on authorized state body in the sphere of sanitary, veterinary and phytosanitary safety;

- transport control - on authorized state body in the sphere of transport and communications;

- control of drug trafficking - on authorized state body on control of drugs.

1.7. The organization and implementation at check points of other types of control, and also implementation at check points of the economic and other activity which is not connected with functioning of the international message, executive bodies, physical persons and legal entities is not allowed.

II. Classification of check points

2.1. Check points are classified depending on type, nature of the international message and operating mode on:

- air, automobile, railway, pedestrian - by the form the international message;

- passenger, cargo, passenger-and-freight - on nature of the international message;

- permanent, temporary, seasonal - on operating mode.

2.2. Check points can be multilateral - for the omission of persons, irrespective of their nationality (citizenship), vehicles, freights and other property through frontier of the Kyrgyz Republic, and also bilateral - for the omission of citizens of the Kyrgyz Republic; the foreign citizens and persons without citizenship who are constantly living in the territory of the Kyrgyz Republic, vehicles, freights and other property through frontier of the Kyrgyz Republic and adjacent state including in the simplified procedure.

2.3. Classification of the check point can be reviewed by the Government of the Kyrgyz Republic on representation of relevant organs of the executive authority of the Kyrgyz Republic, according to rules of international law, taking into account interests of adjacent foreign states.

2.4. Decisions of the Government of the Kyrgyz Republic on establishment of check points with indication of their classification are published in official seal and, if necessary, are led up in accordance with the established procedure the Ministry of Foreign Affairs of the Kyrgyz Republic to the diplomatic (consular) representations of the foreign states accredited in the Kyrgyz Republic, and interested the international organizations, diplomatic and consular representations of the Kyrgyz Republic abroad.

III. Procedure for establishment of check points

3.1. Check points are established by decisions of the Government of the Kyrgyz Republic on representation of the ministries, state committees, administrative departments and local public administrations of the Kyrgyz Republic (further - initiators) in coordination with authorized state body on protection of frontier, taking into account interests of adjacent foreign states.
